    • Good Evening, I've got a fairly simple question but I'll provide some context incase needed. I've pursued a company that has operations in england despite them having no official office anywhere. I've managed to find a site they operate from and the papers there have been defended so I know they operate there. They've filed a defence which is honestly the worst defence ever, and despite being required to provide their witness evidence, they have not and have completely ignored the courts and my request for copies of it. I'm therefore considering applying to strike out their defence on the grounds the defence was rubbish and that they haven't provided any evidence for the trial. However, it has a trial date set for end of june, and a civil application wouldn't get heard until a week before then, so hardly worth it. However, my local court is very good at dealing with paper applications (i.e ones that don't need hearings, and frankly I think they are literally like 1-2 days from when you submit it to when a Judge sees it. I'm wondering if I can apply to strikeout a defence without a hearing OR whether a hearing is required for a strikeout application.   Thanks
    • I have just opened another bank acc with lloyds (i have a few already) After doing some research they may have some relation to tsb or be apart of the same group will this cause me issue if my salary is paid into my lloyds account? Also, if the debts do go into default and nothing is paid then after 6 years it all goes away? As the DCAs cannot do anything? I do want to start paying in like 3/4 months or do you advise I leave it if it goes into default? again sorry for all the questions, i am just processing everything

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Look it is now doing the merry-go-round of the lowest form of DCA's ie, it has reached the bottom of the barrel, one loser has flogged it onto another loser who has zero history of the account, simply because they are in the business of buying lemons.

 

There is zero requirement to reply to their computer, it will go unread, as none of their staff is old enough to read yet, least of all open their eyes, all you need do is to keep up your complaints about these extremely immature puerile companies to the OFT&TS via http://www.consumerdirect.gov.uk/contact

 

Ignore them, there is absolutely nothing they can do, apart from threaten you with words they find in the dictionary!

also i thank you for the link to consumer direct but they do not operate in northern ireland (where i live).

If you are in Norn Iron there is even less chance of a DCA taking legal action against you. The NI Courts require a higher standard of administration than Northampton, for one thing, and the solicitors whose letterheads most of the DCAs use aren't allowed to practice in NI. Even if they get a CCJ, the usual bailiff threats are meaningless in NI as there are no bailiffs.

 

There is an equivalent to Consumer Direct in NI, but the name escapes me at the moment.

i know. what do you mean hit them with both barrells. shoul i cca request all dcas that contact me.?

i havent done it with the latest one-Apex whatever.

CCA all DCA's really does depend on the age of the accounts, what type of accounts they are, and the history, a CCA request isn't a magic bullet that it once was, but will definitely put you back in the driving seat if they cannot come up with one.

just an update.

 

i recieved 4 letters in succession.

 

1 from apex debt collectors, 1 from a solicitor which threatened legal action, then said 'please do not contact us, contact apex' so obviously they are 1 and the same.

another 2 from apex threatening the end of the world then nothing for a while.

 

then i recievd a letter from lombard! they had already terminated my agreement.

i thought it looked familiar so i checked my letters and its the same letter they sent me in november.

then i got the same 4 letters sent from apex and the solicitors. exactly the same, same figures same threats!

 

does this mean apex, the solicitors and lombard are all one and the same?

 

was my 'terminated' agreement a farce?

 

i have ignored them all.

Can you scan and post the children's letters up on here?

REMOVE all ID!!!

 

Give us the names and others can tell you whether they are the same company.

It is quite likely that the DCA is "in house" as is their tame "Solicitor".

update! recieved another threat of court/bull**** letter from a solicitor called greene and co. agents of RBS apparentley.

they always seem to say, contact the original company i.e lombard (RBS). i will be doing the same with this letter as the others... nothing!

update. recieved a letter from LOmbard, which states that they have not been able to extract mo ney from me, and have passed it on to wescott.

 

in other news i have a letter from 'moorcroft debt recovery' with notice of intended litigation from an old overdraft which i had completely forgotten about. I have not had any letter from them previous to this. THey have another account of mine, which they must have got my adress from and decided to resurrect this from.

 

will i sar moorcroft or cca now? is this a minor victory over lombard?/

Send Moorcroft a prove it letter and see what they come back with, if they do. If there are any charges on the account, you may look to complaint about these with the bank concerned.

 

Re Lombard, wait to hear from Wescott and post back.

If the "old" overdraft has a period of 6 years (5 in Scotland) where no payment or acknowledgement of the debt was made its stat barred and you would be within your rights to tell them to "do one"

Thanks but i think its around 3 years, and im in northern ireland.

 

lo! the lombard DCa has just arrived ! its with AIC. never heard of them. it seems very non threatening?/

 

Moorcroft sent me another letter. asking for money again prior to litigation for said overdraught. funny they are going straight for this litigation route. when others havent. the i havent cca'd for this debt .

 

anyway the moorcroft letter was typed in COmic sans! written by a human it seems. Comic sans lol.

Overdrafts are not covered by the CCA, they have an exemption and thus dont require a formal application document, they just have to show youve had the money and you were notified of the overdraft facility and terms of it.

 

Its STILL worth CCA'ing the DCA for the overdraft facility letter tho.
