Can a DCA report a default on your credit file if the debt is statute barred?

 

That is to say, I have never acknowledged any debt or even letter with them, and after six years away, they eventually find my new address, and ask for payment. Theses debts are statute barred, and my credit file is as clean as a whistle. Can they stick a default on my credit file now that they have 'found' me. Just interested to know what I could/should do to prevent this.

 

Is there a data protection law or something that says they can't process info??

I have had personal dealings in the areas I comment on, however, I am not a lawyer. Any new default must replace the old one -ie at the exact same date, not a new one for when they took it over.....so if it was a statute barred debt to begin with, the default would not show up on any search as it would be more than 6 yearslink3.gif ago.

 

What DCA is it?

Have you told them the debt they are chasing is statue Barred?

What kind of debt was it? Loan, Credit Card, Mail Order account?

You know me and my observations ( ex SAS ) you see...STATUTE not Statue, like I said just an observation as I have one eye on the clock one on Eastenders and the other on the screen.
