Hello all,

 

I have been approached by a close family member for assistance as they are having great difficulty in the

 

removal/eviction of their Ex Husband from the ex marital home. He has not contributed to the

 

mortgage payments or any of the normal contributions for many many months and is unfortunately

 

still living rent/mortgage free in the house, whereas my family member has moved out and is paying

 

the Full mortgage

 

payments. The house is currently up for sale and has been for many many months. the mortgage

 

company are well aware of the situation but have not offered any suggestions as how to deal with the

 

problem. Her sol is not forthcoming with a solution and (IMHO) is procrastinating to excess.

 

Any advice / information or guidance will be greatly appreciated.

He does not have to contribute financially to have an interest in the former matrimonial home. This should have been settled as part of the divorce proceedings. If he genuinely has no calling on the property, the usual action is to change the locks having given notice to remove his property by a set date (A Notice To Quit), however, if the property is being sold, it may be more effective to let the sale proceed and move out - after that, should he remain his excuse that it was the marital home carries no weight.
