I am trying to contact bms / booker management services limited, glentor, balland lane, ashburton, devon tq13 7da ON 0845 241 7880 about a barclaycard debt i repay to them. I am trying to contact them for a settlement figure and have had no problem contacting them before but now the line does not connect and i can find no other number for them on any correspondence or internet searches. Can anyone help me with an alternative number or details of any prolems with their company? Much appreciated

Hi Ash

Welcome to CAG

If you're looking to go for a settlement do it in writing as you must make sure that what you negotiate is a "Full and Final" whereby what you pay is accepted as the end of the matter, no balance will be remaining that can be chased at a later date and that your CRF will be marked as "Settled"

If you do it over the phone you'll have no proof should things go wrong later

Good luck

Hello, yes, I will request anything in writing. If I recall they did this for me last time I requested a settlement figure. I am very near the end of the agreement and want to ensure that I end my payments at the correct time, at the very least, if I am not able to settle early. The money can be directed to other debts and the sooner the better, so I want to get organised. I am concerned that their fax number is also a dead line.

THanks for your advice

when i dial from my office phone the display says unalloc number and doesn't give any other message or connect to a line? If it does not receive incoming calls though I don't suppose it matters as I would not get through anyway?

thats what i'm concerned about, if I am making payments and they are not in business and my money is not actually repaying the debt. This happened to a friend of mine who was making payments to a debt management company that went under and customers weren't informed. She has had to rearrange all of the agreements herself and is classed as having missed payments and defaulting on the agreement. Rather unfair!

yep, I would not be surprised. I've posted a letter to the business address but I won't hold out much hope. I'd stop my payments, as no doubt they'd be in touch with me on no time but the most recent payment was yesterday so it will be at least another month before this will make a dent plus I do not want to default on the agreement.

Hi ash

Mine was the message I got dialing from a 'normal' number (no switchboard) at 15.30. Many of these numbers are 'fluid' and can be re-routed at will; you'll probably get Ann summers on Monday.

Interesting scenario that vic

Wonder what kind of Full & Final could be negotiated from them

Knowing my luck I'll never get to find out

the question must be asked is why are you paying these fleecers in the first place?

did you CCA them before you started to pay them?

have you checked the 'balance' you have been paying does not include unlawful charges &/or mis-sold PPI?

easiest way to get their attention is to stop payments.

how do you know you've notbeen lining someone's pocket all this time?

needs investigating

if anyone ever does consider an F&F all these things need to be done as a matter of course

and the F&F will only be paid if they agree to marked the debt as setlled AND remove all default/neg markers

or remove ALL trace of the A/C ever existing on the CRA files.

else DON't, even a debt marked 'settled', is just as bad as a CCJ if it has any neg markers.

please don't hit Quote...just type we know what we said earlier..

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

OK... now i'm more concerned. Forgive my ignorance, but what does it mean to CCA somebody? Thye balance of the debt was correct, although regards PPI etc I never considered this. Having recently been successful in a PPI claim against another lender, I would be interested to find out if thats the case. Thanks for the advice and if you can let me know what CCA means I can check this out. I see what you mean about checking these types of companies out but the demand letters tend to make a less clued up person assume they have no choice in the matter and to pay up

Send them a CCA request to see if they are entitled to collect this debt & if it's enforcable. If they fail to provide it within 12+2 days or the CCA is unenforcable you can legally withold any payment until they do. Send it recorded delivery enclosing a £1 postal order. When you get a reply, scan it & remove any identifying details and post it back here where we can have a look at it. We'll advise you from there;

Dear Sir/Madam

Re:- Account No: XXXXXXXX/Your Reference Number: XXXXXXX

This letter is a formal request pursuant to s.77/78 of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide.

I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.77 will apply.

If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties.

Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Consumer Protection From Unfair Tradinglink3.gif Regulations 2008 (CPUTR).

If you intend to send a reconstituted copy of the CCA you must declare the reason why it has been reconstituted and if the original exists and in what form (microfiche) etc

I enclose a postal order in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose.

If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee.

(Optional)

You should also note that I will only discuss this matter in writing and should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you or any of your associates.

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance. (Optional)

I look forward to hearing from you.

Yours faithfully **Edit to suit**

A previous licence for this address existed in 2006-but under a different name.

Theres no suggestion that this company is linked with BMSL

Anyway, since you have been unable to contact them, would not go amiss to call Devon Trading Standards and ask them if they are known to them.
