Letter from Pace Forward 2 weeks before Christmas

PLEASE, please, please can anyone advise me on what I should do. I recieved a general letter saying they were looking for me to discuss a personal matter and to call them. After reading a little on here I'm unsure what to do next. I know not to call but do I send them a letter asking them to explain what it's about or do I ignore it and see if they chase it up.

I wqent to university 1997- 2001 and was a bit stupid with money, but I'm sure I don't owe anything.

The letter came to my new address but under my maiden name. I'm currently on maternity leave and due to return to work for only 11 hours a week in January so I'm so worried in case I owe lots of money! I'm so worried especially at this time of year. Can I enjoy a worry free Christmas?

 

Any help will be so much appreciated!!!

Hi Worriednewmum

 

As far as the statute barred nature of any alleged debt will depend on the last time you acknowledged it in writing or by payment.

 

You can do one of two things, ignore it, or you can send a letter "prove it letter", I believe there is one in the letter templates.

 

What I would say is dont worry, i know that sounds very flippant but honestly they cannot do anything to you at the moment and in the very worst case scenario, if they did have grounds for you to make a payment, it will be at what you can affiord, if they disagree get them to take you to court, a judge will only award them the minimum payment you can afford to make.

 

Try not to let it ruin your christmas, it really isnt worth the worry! I was in a terrible state and now three years down the line i actually welcome calls or letters from DCA's so that I can give them both barrels!

ignore them totally!

 

such a general letter is well against published debt guidelines...

 

its what we call a phishing letter

......phishing for a mug to fleece for a debt that prob is not theirs or is well statute barred, hoping the MUG knows no diff and starts to cough up.

 

forget about it

 

NO dca has ANY LEGAL POWERS anyhow

 

so whatever you do, never ever respond.

 

if they or the OC were really serious about wanting this money - why leave it 10yrs to ask!!!

Absolutely agree with all that has been said above.

 

By their very nature these types of people are at their happiest when causing major distress, and boy do they love Christmas Time. Please do not let them spoil Christmas for you and your family otherwise they will have something to gloat about. You have received good advice, so forget all about them, even if they return or increase their threats during this Season, just laugh in the face of it and reverse the process and think you are one person who has failed to add to their Christmas Fund.

Well it's just fortunate you came to the right place first and asked before falling in to their clearly marked trap!

I'll just echo the above, you really have nothing at all to worry about here file their foolish letter away under ignore and see if they can afford to send you any more missives before Crimbo...

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I recieved a phone call last night asking for me in my maiden name and if this was the address that they sent the letter to - I presumed it was them and said that I wasn't this person (true seeing as though that's not been my name for 2 1/2 years, not so true about the address bit though). Hopefully this can be the end of it. I'll update this as soon as there's anything to update you with.

Did you ever bank with HSBC by any chance?

Is that not normal for students to do exactly what you have described in your post, be ' stupid with money ' you obviously did not have Mummy and Daddy to guide you through your years of partying, you probs just had a mam N dad like me, but now you have the caggers and we are all part of the same family, so stop worrying and do as your told, keep us informed and you will be directed to the relaxation suite where you will enjoy a worry free xmas.

Hi,

 

I bank with HSBC now but definately been no problems. When I was at uni I banked with NATWEST but closed the account and credit card account in 2000. This was when I was in and out of debt to them. I thought that when I went into the branch to close the account all monies owed would have to be paid in order for me to be allowed to close it. I know I had to pay off my overdraft which I did)?

I suffer with post-natal depression and this is driving me crazy.

Just had another call asking for me in my maiden name. I said she didn't live here. I was asked has she ever and I replied no which is true to an extent in that I have only lived here since I was married. I asked who was calling and they changed the subject. They said they would change the files.

I dialed 1471 and redialed the number ... it's Rockwell!!!! Help!!!!

Agreed, as soon as you know it is them, just put the phone down, they can't (CANNOT/WILL NOT/COULD NOT) do anything to you, they have NO legal qualifications OR ANY rights over you, what they are doing is harassment, if I kept ringing you up and asking you if such and such lived there, or ever did an wouldn't take no for an answer and kept on ringing you, you'd report me to the Police for harassment?

You need to view these fools in exactly the same light, it is your house, where you live, and it is your phone, allowing them to try and intimidate and control you in your own home should be met with an extremely robust attitude and actions.

in addition to all the Excellent advice on thes Forums I would also just post a blank envelope with NO STAMP on it back to them with a UNSIGNED simple Foxtrot Oscar message.

 

If everybody sent back unpaid envelopes back to these sleazebags the whole process would rapidly grind to a halt.

Remember when dealing with DCA's YOU have to take control -- most of them have NO POWERS whatsoever regardless of what they say.

 

A few like CAPQUEST and RESTONS need slightly different handling but you will find help on these boards for dealing with them too.

 

99% of the time you can ignore threatograms etc from a typical DCA.

Hi there

Another DESPICABLE part of the whole debt collection industry -- SARL means a LUXEMBOURG based operation -- no UK tax with the directors pocketing ZILLIONS and not paying a penny in UK taxes.

 

Apart from anything else report them to Companies House and the Inland Revenue if you get stung by these a**holes -- if you pay themANYTHING make sure at least its recorded in their tax returns.

 

S.A.R.L means normally a Luxembourg based operation such as CAPQUEST against whom most caggers have good reasons to see if they can be shut down too.

Hi,

Thank you all for the advice, it really helped me to have a lovely fisrt Christmas with my new little family!

Thankfully the phone calls have stopped but the letters haven't. I finally gave up and sent a 'prove it' letter to which they replied saying that they can confirm th name and account number - Does this count as proof? I certainly didn't ask them to confirm anything just show me some proof.

Any ideas what I do now? Ignore them or send a letter to say the debt is over 10 years old and to therefore leave me alone?!

Did they not say who the account was with? and if they did, did you have an account with the named creditor?

 

That's the whole point of a 'prove it' letter, to give you the information to make an informed decision.

 

If you are certain you haven't had any debts for over 6 years, send the SB letter

If you are asked to deal with any matter via private message, PLEASE report it.

Ignore the puerile fools, what are they going to do? Really?

 

I tell you what, continue sending you utter nonsense through the post if you reply to them, ignore them, file them all away, keep a diary of events, if they insist on harassing you over the phone, report them to the Police for the criminal offence of harassment. They're pathetic letters are written by the weak minded intended to abuse the weak minded, and threaten and intimidate, so don't let them! Laugh at their immature paragraphs, ring them up and tell them you have received their latest letter and you laughed so much it gave you a hernia, please can they continue to send them, as your father is in hospital and could really do with some cheering up, Mr Tumble is getting a little tedious for him!

If you are sure that you have not acknowledged the alleged debt in the last six years then you can stop worrying.

 

The phone calls have stopped so you dont have to listen to them, if you want you could send them the SB letter but to be honest they probably already know, bottom feeders like them usually specialize in SB debts.

 

Personally I would ignore them, they wont even dare to take you to court, they know the court wouldnt entertain a claim under those cicumstances.

 

What i would do, is check your credit file, just make sure that they are not stamping all over it.
