capquest/ barclaycard - judgement for claimant via CCJ on 2-12-10

Hi all

 

had a ccj letter sent to me from the court on behalf of capquest/ barclaycard.....................thing is forgot all about it and now I have had a letter from the court telling me I have to pay them the whole lot !!

 

I know I know ! I should've done something about it - but is it too late now ? can I still argue about it and CCa them or is it definitely too late??

Unfortunately I wasnt quick enought to respond to a request from capquest via barclaycard to hit me with an amount they say I now owe.

 

I know ! I should've responded but one thing and another happenened next thing I have a letter through my door stating I now have a ccj and I have to pay the amount owed.

 

No payment agreement has been made is it too late to to cca them ? - I have in previous times called barclaycard and asked them for proof of my signature to no avail.

Or should I just accept my fate now ?

Can you give some more details? Did you receive the POC and Judgement and when was this claim awarded? If you do not have all the paperwork please contact the court and ask them to send it to you. Also did Crapquest claim the full amount?

 

I am a legal numpty but know that you may have grounds for a Set Aside but it depends on the circumstances. If you can provide more info, the legal brains will have a look.

So now it all gets a LOT worse !!!!!

 

Had a judge for claimant on 2-12-10 in favour of Capquest have to pay sum asked for .

 

then I now have an interim charging order letter sent to me on -- said on 31st march will hear application as to whether the order should continue or be discharged at Bradford.

 

mortgage co knows about it (flippin 'eck!)

 

Hubby knows about it !

there is an official copy of register of title attached (?)

 

Hearing to be held AT 12:00 on --

 

 

Then I had another letter from |Capquest solicitor via land registry office dated 21-2-11 form B136(cO)Notice of an application to register a restriction against the land. It reads that there will be a charging order but if I dispute it from how its written they'll do it anyway (?) I have until noon on 14 March 2011 to dispute this .

 

 

So what to do ??? I haven't cca'd or anything on this account unfortunately I played the part of the ostrich and now it's come back and bitten me right up on the backside

 

do I dispute the laim or should I offer a settlement ? or installments?? I am clueless sorry

 

So if ANYONE can help me I would be soooooooo very grateful

If I send a copy of SAR and CCA request to solicitors capquest and the court will this make a difference do you think ? or should I shut up and pay ???? I have'nt proposed to make any kindof payment yet either - should I do this ?????
