Hi there, I have already sent 3 letter to Lloyds and they have dutifully shuffled them round various departments achieving nothing for me. It deals with 1) Debits taken erroneously and 2) charges applied after the account went into debit.


I will now try and explain:


I made a debit card transaction to a foreign bookmaker (I think it was bwin.com - sponser Real Madrid etc.) and duly my Available balance reduced by that amount. A few days later when I came to check the Available and Account balance, the Available and Account balances showed the amount BEFORE the transaction was taken into account. So, I withdraw more money. My Available balance thus being reduced by that new debit amount. Later that evening (approx. 45 minutes later) the Available and Account balances were reduced by the original debit amount, and subsequently a few days later the Account balance reflected that available balance.


My point is, are Lloyds TSB at fault for failing to correctly report my available funds and thus allow me to debit amounts which aren't there and exceed my overdraft limit? I discovered that on the day the transaction should be reflected in my account balance, the following occured:


22:30 Debit amount disappears, raising Account and Available balance by that amount

23:15 Debit amount re-appears reducing Account and Available balance by that amount


Thus any monies withdrawn between these times were completed without accurate information as to the state of the account. I am wondering if anyone has any idea whether I have a valid legal arguement that because of Lloyds TSB's negligance in failing to accurately report the state of my account, the withdrawls should not have been permitted and thus they are liable for them and should refund the amount, along with charges incurred as that same negligance caused the account to exceed its overdraft limit?
