Defaulted on an £8k secured loan 3 years ago which has now is now £13k when I lost my job.

 

Since then I have been working but the jobs have been much lower paid

I would not have been able to pay my contractual payment of near £300 per month.

 

I've been on reduced payments for 3 years now.

 

Every 3 months I have to send my bank statements and they question every entry

they believe is not essential and I have to justify why I spent money on that item.

 

Well I'm really fed up with the patronising collections and I want to tell them I'm working

but I don't earn that much and I'm really struggling financially.

 

They have told me that I can't stay on a reduced payment plan indefinitely and this time he was really threatening.

 

Ok, I hold my hands up I've not been entirely honest with them about working

but I need to manage this situation before they find out something and decided to take my house away.

 

What advice can you give me to try to manage this situation.

 

I will cancel the payment protection which will reduce the outstanding balance but there is still the question of the rest.

 

Secondly, does anyone now how I could possibly get rid of these people without losing my house?

 

How can I get these people of my back.

Right, I only read your first para where you have been sending them info they have no legal right to see.

 

So that said,

DO NOT talk to the phone drones over the dog and bone,

if they ring tell them "Everything in writing" and hang up.

 

If they persist, tell them "Everything in writing your harassment is being recorded" then hang up.

 

Keep a diary of events from now on, especially where the phone calls are concerned,

you should consider reporting them to the Police for the criminal offence of harassment if they insist on ringing you.

 

They have NO LEGAL right to any of your personal and private info such as I&E, what you spend your money on is your business,

would you feel at ease posting on here what it is you earn and spend your money on? NO!

So they do not need to know either, they are punching well above their weight, ignore their immature requests.

 

I see you mention PPI,

why haven't you claimed on it?

And it beggars belief that you are still paying it??

You need it NOW, so claim on it!!!!

 

If they foolishly turn round and say you don't qualify,

then you MUST consider reclaiming all of the PPI you have paid, back, this will go to reducing the total amount owed.

 

This is what you pay PPI for, so when you fall on hard times it is paid for you.

 

When exactly in 2007 did you take this loan out?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

It sounds as though you already have, but just to make sure you haven't got any account or savings with any of the Lloyds group have you? If you have move them!

The PPI is something you MUST look at.

 

On a loan of that amount it can be a very large chunk.

 

There are many reasons for claiming it back.

 

When you lost you job did it pay out?

 

Did they in sist you have it?

There is an expression used up north..' Can of worms ' and you have just opened it, you need to take heed of what previous cagers have advised, stop swearing ( immature ) and get this sorted as the oc is taking the mick, over to you !

When I lost my job they said that I was not entitled to claim on it

because I had not been in a permanent job for more than 6 months.

 

I cancelled the PPI on both of the loans.

 

However, the one on the secured loan never got cancelled.

 

What can I do long term to get rid of them, I'm a bit worried because it is a secured loan,

 

i don't want them to take my house so that's why I've just done what they have told me.

 

Hence sending in the bank statements etc.

 

Can you give me a strategy or ideas on how to manage this them going forward...

 

 

How do I start the ball rolling with claiming back the PPI on this loan?

 

I have two accounts with Lloyds, but I have a poor credit rating now so it is difficult to find another back really who will offer me a current account. Any ideas on who I can use?

 

I'm worried they will start legal proceedings if I don't do what they tell me. If I don't send them my bank statements they may take me to court? Isn't that the case?

The only person entitled to your Personal Finance details is a Judge not a DCA

 

Move all banking activity to another banking group if you have a dispute - your funds can be used to offset debts within the same group.

Be careful with Banking details (card/account numbers) as these can be used to take unauthorised payments.

Even though you cancelled the PPI on the unsecured loan, did you make any PPI payments on it? If so, then you need to claim this back.

What is their reason they give you that they cannot cancel the PPI on the secured loan? Sounds like a load of rubbish to me, have you been using the PPI on this loan?

If not claim it back also.

 

There will be no quick fix to this, especially as you state that you weren't completely honest with them about your employment.

Hi ladylovessalsa, which i might add is a terrific username !!

 

My husband and i are currently taking Black Horse to the Financial Ombudsman for dodgy dealings.

please never ever send your personal statements to them.

 

tape all phone calls and advise them before the conversation by saying to them

'i have to advise you by law that i am recording this conversation for my records and proof of what has been said'

if you haven't got a dictaphone use the recorder on a mobile phone and transfer to a computer cd.

If they won't, you have this on tape !!

 

With regard to finances, call a group called CCCS, who are a seperate body and they will help you with a financial statement

( you can look these up an google) they are good.

 

PPi is only for people who are working 16 hours or more.

If you write to them, only wrote to head office and send via guaranteed recorded delivery,

track the letter and print out the proof of delivery.

 

Believe me this company is a disgrace and you have to fight fire with fire..

Just to be clear, it only been since 2008 that I haven't honest about what I'm earning

because I can't pay keep up with monthly repayment of £417.00.

 

When I took out the insurance I was earning £4000 per month but I was a contactor

and to claim I needed to be in full time employment for 6 months prior to the claim

which was not explained to me at the time.

I've applied for a COOP bank account and sent reclaim letters for both the loans.

 

I'm not sure when in 2007 but as I said I'm worried because the 3 month arrangement is due to end

and they will want me to call and to agree another 3 months and send in my bank statements.

 

I don't want to and from the advice you have given me I will not send them again.

 

I don't want to come across as not wanting to pay anything...

please help I'm worried..

It is pointless worrying......worrying is like a rocking chair, it gives you something to do but gets you nowhere!

Fill out an I&E form for yourself, so you can see what is going where and then you can make an informed offer of what you can realistically and comfortably afford to pay them, I can assure you that any I&E forms they send you will not be as comprehensive as they should be. I'm coming round to the idea that in some situations it is better for the debtor to furnish the creditor with their own I&E info, however i would definitely stop at sending them any bank statements showing them every last penny!

Have a look through the above link and find a budget sheet applicable to you, or edit one to suit, then work out how much you can realistically and comfortably afford to pay them each month, tell them, give them a copy of YOUR I&E sheet if you wish, nothing else, and start paying the amount YOU told them you would.

OK, I take your point. Just don't worry unnecessarily, as long as you are corresponding with them, and offering them what YOU can realistically afford then you won't go far wrong, you need to take the reigns back and start controlling this, inform them on the next 'appraisal' that you have worked out your own I&E, of which they can have a copy, and it clearly shows that there is only X amount disposable income left each week/month, therefore your offer is £xx.

Don't forget you need to have a life too, so ensure you set aside money for socialising clothes etc.

A cash withdrawal at an ATM would solve that problem. If, for example, you have a transaction on your bank statement showing you used some form of bank card to pay for cinema tickets or similar then you will never get those people off your back.

You have no obligation to speak to them on the phone. The only reason they send threatening letters is so you phone them so they can threaten you some more. Keep it all in writing and keep copies of all letters, yours and theirs.

Hi there

Blackhorse is better known as LLOYDS / TSB's LOAN SHARKING DIVISION --excessive interest and charges.

 

Make sure you claim EVERY PENNY back for PPI etc. It's also amazing how a loan can grow so quickly from 8,000 to 13,000 GBP.

 

Why is it ALWAYS those who can least afford it are hit with these really excessive and exhorbitant costs and Interest Charges.

This was a secured bank loan with Lloyds TSB for £11K in 2001,

we consolidated it 3 times which brought it up to £20K

and we were paying the correct monthly instalments of £450 per month

until 2007 when my circumstances changed and I got divorced and

I was left in severe financial difficulty and with this debt.

 

I haven't paid anything on the loan since 2008 and

they have finally tracked me down to my current address.

 

Over the course of the last 3 years it had been through a number of different DCA's

but this letter attached is one of two letters I have received at my current address.

 

Please help

they say they will send someone round and that they will pursue me through legal channels.

 

Can they clamp my car or take things out of my property?

 

My husband left me with this debt and now I'm responsible for it,

he didn't pay a penny and I just can't afford to pay as I look after the children and he gives me nothing.

 

I don't know what to do, please help!!

Relax, they cannot do anything like that.

The worst they can do is take it to court and get you a CCJ.

 

worst that would happen then is you'd be ordered to pay a pound a month.

That is a long way off and there are ways of dealing with them.

 

Firstly do not ever speak on the phone to them.

 

Next send of a CCA request.

 

You can find a template on here in the library.

 

Send a postal order not a cheque and don't use your normal signature.

 

Lastly keep this thread updated and STOP WORRYING.

they can do nowt of the sort

 

no DCA has any legal powers to do anything to you.

 

and if the OC wanted their money, why have they waited 3yrs....???

 

i bet you had PPI on these loans & p'haps heeps of charges, that were rolled over from loan to loan , without a rebate.

 

and they know your reclaim could be greater than what you owe Lloyds , and thats why they've sold it onm a phishing list..

CSL are inept at their chosen career to say the least!

Besides they, as DX said, CANNOT do anything, they are not Bailiffs, nor are they experienced enough to put this in front of a Judge.

 

Do their letters state they are chasing this on behalf of their "client" or do they claim to have bought this?

Has Lloyds sent you any letters saying they will be passing it onto a third party clown outfit to chase on their behalf?

 

What will have happened is that Lloyds will have been paid in full, for the loan by their insurers, plus they will have got tax relief on this, then they will have either passed it onto this circus act in the hope of getting money which they make a profit on and can pay the fat cats their multi million pound bonuses, so don't lose any sleep over it! And if they have actually 'Sold' it to these fools, then they will again have made a profit by selling it to CSL who don't have a hope in hell of intimidating you enough to part with your hard earned.. Relax, look forward to the postman bringing you their begging letters, file them away, or use them for the hamster's bedding.

Hi Lady, deep breath and follow the advice of all these guys above who have posted.

 

Step by step.

 

They are hugely experienced and you can trust them.

 

Just post up when you get a new letter so you can be reassured.

Offered F&F to all my creditors. All closed out including a particularly intransigent and stubborn one - who eventually saw sense after 10 months of nonsense!
