I am in really huge trouble.

 

I had a loan with SwiftMoney which defaulted, this was over a year ago. Stupidly it was head in the sand time and I ignored the emails & letters. At the time of default, I cancelled my debit card so they couldn't take any money.

 

Yesterday, I received an email from SwiftMoney stating that they had successfully taken £575 from my account (2 x £250 and 1 x £75.00). I have no idea how they managed to obtain new card details. I have confirmed with my bank that this is the case and they say that I have to wait for the charges to appear on my statement before they can dispute.

 

What do I do? This has left me with £11 to feed a family of five for the month. Are they allowed to do this?

No, they are NOT allowed to do this but they get away with it because the banks mistakenly believe that because you have given the card details they also have your bank details - this is because you usually have to send a scan of your card.... your bank details are on it.

 

Get onto your local Trading Standards, MP, Office of Fair Trading and Ministry of Justice with a complaint

 

The more people complain about this practice the better.

Surely this could also be classed as theft and fraud by Swiftmoney.

I would get down to my branch and complain, You never gave this company your details and most certainly didn't

authorise any payments from your account.

I would also call at the local police station and report it so you get a police reference number as otherwise the bank

won't do anything.

If the police try to fob you off don't take no for an answer, demand they investigate the theft from you bank account.

maybee they should hertsboy with theft that would be there response.

 

eitherway tell your bank the transaction was fruadulant and stick to your guns if they try to fob you of and demend they (your bank) pay it back to you.

Have you applied for another payday loan since defaulting with them?

 

You may have applied with a company affiliated with them where it's hidden in the terms and conditions that you agree to share your information with anyone where you have an outstanding balance.

 

I'd definitely challenge it but if you've done the above your bank may well side with Swift Money I'm afraid.

In all fairness, yes they maybe shouldnt have taken the money but i am almost certain that you would have applied to borrow elsewhere and thats where they obtained your details from. If it is the case that you applied elsewhere for a payday loan when you had failed to repay another do you think that they would feel that you got your just deserts? The only reason i say that is because it happened to me and i was taking the micheal if im honest so held my hands up to it and said "its a fair cop"
