hi

Brief history my debt has been sold to link financial from GE money

i haven't been in touch with link yet and i couldn't reach an agreed monthly payment with GE .

 

I will type the letter as it has been written .

 

Dear ...

 

YOU HAVE BEEN SERVED A NOTICE

 

You recently received a letter from us regarding your GE Money consumer lending limited account (.......) .that letter was a legal requirement under section 136 of the law of property act 1925.

 

We are dissappointed that you have not acted upon our instruction and contacted our office.

Please contact us upon receipt of this letter to discuss your outstanding balance.

Please contact us on 0844 7368413.

Unfortunately, if you do not call,we will take further recovery action.This may lead to the balance being increased through court cost and interest charged .

 

We are therefore giving you the option of paying back the assigned balance £.... to link financial outsourcing .

 

Yours

 

The 1st letter i recd last week said they purchased the debt from ge money and i should contact them nothing else .

 

Anyone got any thoughts ???

Hi Alane,

What you got originally was a Notice of Assignment, which they are required to send if they purchase the debt.

It does amuse me how important they try to make themselves sound!

And how arrogant...you were INSTRUCTED!!! How dare you not respond!!

 

What utter tosh.

 

Standard threatomatics.

What's the position with this debt? Have you sent a CCA Request? Any unfair charges or missold PPI you can claim back?

Hi

 

Had a loan with GE money got into difficulty they wouldn't accept lower payments although i did make lower payments for a few months then it passed to link about 2 weeks ago .

 

This is the second letter and ive had post cards from link in the post and loads of calls .I have read a lot on here about link so i haven't called them .

They only have my house number so they can call all they want the phones not plugged in ,i don't use a land line anymore only for the internet connection .

 

Should i write and offer a payment ??

Hi Alane,

At some stage, maybe.

 

First we need more info...

  • Is there any possibly mis-sold payment protection insurance on this account?
  • When was the account opened?
  • Are there any unfair charges on the account?
  • Have you received a Default Notice / Termination notice
  • Is interest still being added?

It depends on you how you want to proceed. Charges/PPI can be reclaimed (with interest on refund) to reduce the balance.

 

Before I paid anything I personally would request a copy of the agreement and send a Subject Access Request to the original company to get all the info they hold on you and check for charges etc.

Hi

 

there is no ppi on this account but i am reclaiming it on 2 credit cards with mbna

account was opened in 2004 approx

there are some £30 charges when i missed payments

yes i have recd a default notice

no interest being charged that im aware of

I cant believe what a rip off the finance was original amount was (not exact figures but close ) £3000 ive been paying £57 a month since august 2004 and i still owe 2300 approx

What a rip off !! and i have found that i have had PPI on the loan it was added upfront at a total of £400

 

im pleased i file paperwork properly

Hi Alane,

OK well what matters is whether THEY have a copy!! They need one to enforce this debt..

No need to mention your own, LOL

If they can't provide one they can't enforce, its then up to you how to proceed. It would put you in a better bargaining position to negotiate fair payments or a low Full and Final offer, or enable you to lawfully withhold payments if they cannot fulfil the request.

If they do produce one, you're no worse off than when you started, indeed they'll know you know your rights so would be less likely to mess you about.

The PPI..was it compulsory? Were you led to believe you wouldn't get the loan without it?

Were you self employed/retired/unemployed or otherwise unlikely to benefit from it? All good reasons to claim it back :-)

Yes like other PPI i had im sure i would not have been able to claim as the company i worked for at the time had a good sickness and accident policy for example if i was off sick-- full pay for 6 month half pay for 6 months then reviewed by the company director and accident cover was provided with the job i work in construction .

I had NO idea it was included and it definitely wasn't explained to me .

To be quite honest, I think they've had their pound of flesh out of you!

Any chance you could scan up your own agreement onto here for checking, (blanking out personal details/barcodes) its not my area of expertise but the way they account the PPI is also crucial so it would give us an idea what we're dealing with while you wait for their response to the CCA..

scan it up or use a digital camera? phone?

 

scan the required letters/agreements/sheets

remove all pers info inc barcodes etc but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.
