    • I did. But I have a problem with my laptop I think because it keeps using my info somewhere in the background even though I only ever use her name etc. I think it remembers me from an old case.    also, whenever I use the government gateway I get problems as it keeps using old logins from other people who I’ve helped in the past with tax returns. I’ve tried clearing cookies and  browsing history but it keeps happening. Eg I put in a gateway code and password but it shows as error because the password doesn’t match the code it’s decided to use. It’s driving me nuts.

I should first send email to bailiff saying x2 previous PCNs for same street went to tribunal & I won , this one I never received any correspondence so could not defend it else I would have & will now be defending it?   2. email the council tell them similar thing , send them tribunal decision of other two?   I need to get confirmation alleged contravention fir this PCN . How should I do that in terms of getting the council to release those details to me?   thanks
    • DX,   I've just noticed something, if you look at the uploaded documents relating to the CCA #6   You see the 2nd and 3rd page are contracts the first one is a blank contract the 2nd one is a digitally signed contract for Very. I can only assume the originally creditor sent the contracts digitally to the DCA and it looks like one of them has either been printed out as a blank page or they have removed the information from 2nd contract and made it look like 2 seperate contracts?   It looks like they only have information relating to Very and not Littlewoods? surley a none signed contract with no name detailing no amount of credit is not legally binding in court?   It looks like if it gets to court they'll go for the Very account but not have a case to argue the Littlewoods one?   Shop direct own both companies so assuming regardless of one signed contract for one company name would still need a seperate contract for another? and one signed contract doesn't work for both?   If this does go to court at what point do I ask for the hearing to be done local to me?
    • For Chrissake simeon!!!   Of course you cannot find para 18(d) that I referred to in #120!!!  That is because - if you had bothered to read #120 post correctly - you would have seen that para 18(d) is in FTMDave's post #105.   One of the improvements that FTMDave had made in #105 to my earlier draft was to replace my paras 13 and 14 with a single combined para 13.  This reduced the total number of paragraphs by one.  That was a good thing to do.   YOU in #121 then reverted to my earlier draft, thus wrongly reinstating para 14 from my draft which FTMDave had removed .  This meant that the para 18(d) that I referred to in #120 had become 19(d) in your version in #121!!!    So when I referred in #120 to FTMDave's draft in #105 and to para 18(d), I was referring to para 18(d) in #105, and not to any draft that I produced days earlier or that anyone else had produced.   And then, now that the para 18(d) confusion that YOU have created is sorted out, you must surely understand my references to para 19 after para 18(d), and to adding a new paragraph 20   Do you understand now?  (You must stop reverting to ealier draft versions and stick with the latest - otherwise it becomes incredibly confusing for all of us and you won't get this counterclaim completed in time!!!)   ========================================================================   All I can really advise you to do now is to read FTMDave's suggestions in #131, and follow them!   (You might find it helpful if you read again all our posts from #120 onwards to help you understand FTMDave's advice.)   You need to sort out your attachments (or exhibits if you prefer).  You've got them in front of you - we haven't - and you understand them better than we do.  Just make sure they are numbered and ordered correctly and are cross-referenced correctly to the Particulars of counterclaim.   Add in interest as per FTMDave's instructions.   And that is it.  From here it's not rocket science, it's just common sense.  If you don't understand by now we can't help.  You just need to polish it off.

Any help is gratefully received.

Brief history my debt has been sold to link financial from GE money

i haven't been in touch with link yet and i couldn't reach an agreed monthly payment with GE .

 

I will type the letter as it has been written .

 

Dear ...

 

YOU HAVE BEEN SERVED A NOTICE

 

You recently received a letter from us regarding your GE Money consumer lending limited account (.......) .that letter was a legal requirement under section 136 of the law of property act 1925.

 

We are dissappointed that you have not acted upon our instruction and contacted our office.

Please contact us upon receipt of this letter to discuss your outstanding balance.

Please contact us on 0844 7368413.

Unfortunately, if you do not call,we will take further recovery action.This may lead to the balance being increased through court cost and interest charged .

 

We are therefore giving you the option of paying back the assigned balance £.... to link financial outsourcing .

The 1st letter i recd last week said they purchased the debt from ge money and i should contact them nothing else .

 

Anyone got any thoughts ???

Hi Alane,

What you got originally was a Notice of Assignment, which they are required to send if they purchase the debt.

It does amuse me how important they try to make themselves sound!

And how arrogant...you were INSTRUCTED!!! How dare you not respond!!

 

What utter tosh.

 

Standard threatomatics.

What's the position with this debt? Have you sent a CCA Request? Any unfair charges or missold PPI you can claim back?

Hi

 

Had a loan with GE money got into difficulty they wouldn't accept lower payments although i did make lower payments for a few months then it passed to link about 2 weeks ago .

 

This is the second letter and ive had post cards from link in the post and loads of calls .I have read a lot on here about link so i haven't called them .

They only have my house number so they can call all they want the phones not plugged in ,i don't use a land line anymore only for the internet connection .

 

Should i write and offer a payment ??

Hi Alane,

At some stage, maybe.

 

First we need more info...

  • Is there any possibly mis-sold payment protection insurance on this account?
  • When was the account opened?
  • Are there any unfair charges on the account?
  • Have you received a Default Notice / Termination notice
  • Is interest still being added?

It depends on you how you want to proceed. Charges/PPI can be reclaimed (with interest on refund) to reduce the balance.

 

Before I paid anything I personally would request a copy of the agreement and send a Subject Access Request to the original company to get all the info they hold on you and check for charges etc.

Hi

 

there is no ppi on this account but i am reclaiming it on 2 credit cards with mbna

account was opened in 2004 approx

there are some £30 charges when i missed payments

yes i have recd a default notice

no interest being charged that im aware of

So its just a matter of whether they can come up with a valid agreement.

 

I would send them a formal CCA Request (Consumer Credit Agreement request)

 

Full details on how to go about it are in my blog as above. (Saves me getting RSI! :wink: )

I cant believe what a rip off the finance was original amount was (not exact figures but close ) £3000 ive been paying £57 a month since august 2004 and i still owe 2300 approx

What a rip off !! and i have found that i have had PPI on the loan it was added upfront at a total of £400

 

im pleased i file paperwork properly

Hi Alane,

OK well what matters is whether THEY have a copy!! They need one to enforce this debt..

No need to mention your own, LOL

If they can't provide one they can't enforce, its then up to you how to proceed. It would put you in a better bargaining position to negotiate fair payments or a low Full and Final offer, or enable you to lawfully withhold payments if they cannot fulfil the request.

If they do produce one, you're no worse off than when you started, indeed they'll know you know your rights so would be less likely to mess you about.

The PPI..was it compulsory? Were you led to believe you wouldn't get the loan without it?

Were you self employed/retired/unemployed or otherwise unlikely to benefit from it? All good reasons to claim it back :-)

Yes like other PPI i had im sure i would not have been able to claim as the company i worked for at the time had a good sickness and accident policy for example if i was off sick-- full pay for 6 month half pay for 6 months then reviewed by the company director and accident cover was provided with the job i work in construction .

I had NO idea it was included and it definitely wasn't explained to me .

To be quite honest, I think they've had their pound of flesh out of you!

Any chance you could scan up your own agreement onto here for checking, (blanking out personal details/barcodes) its not my area of expertise but the way they account the PPI is also crucial so it would give us an idea what we're dealing with while you wait for their response to the CCA..

Also, just so you can further see the injustice, Link only will have paid in the region of £230 for the debt yet will try and recover the full amount, the bank will have written most of the rest off against tax.

scan the required letters/agreements/sheets

remove all pers info inc barcodes etc but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.
