Hi i checked my equifax credit file and mem have put a default dated 01.08.10. I had a loan with them end of last year which was passed to their dca. No default notice recieved. I had an arrangement which i kept to but for no reason they sold it on. In. april i got letter from mcenzie hall about the debt and i sent letter requesting proof they own the debt but never heard anything. What is my next step regarding default? Thanks

It is a default notice served under Section 87 of the CCA1974.

 

I beleive a creditor can now send a copy of an a agreement and copy of a defualt notice as long as it is legible and contains all the relevant information. This is deemed as acceptable by the ICO and courts if they can provide evidence as to why it should be there.

 

On that though the information they record with the CRA's should be accurate and show a true picture of what was actually owed.
