    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share. 
    • To re-iterate and highlight my urgent question on this one: The N24 from the court did not include any instructions to submit paperwork 28 days before the date, unlike the N157 received for other smaller claims. Do I have to submit a WS for this court date? Link has!...
    • No, reading the guidance online it says to wait for a letter from the court. Should I wait or submit the directions? BTW, I assume that the directions are a longer version of the particular of claim accompanied by evidence, correct?
    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Wonder what your advice would be given the documents they have provided? I am now in a position to clear the debt either by lump sum or a few large installments - Is this something i should look into at this late stage? Thanks as always in advance
    • I have now received my SAR. It includes a great deal of information! Is there a time limit on how long account information is kept and/or can be provided to debtors? I have received many account statements which were not previously sent to me. I remember that the creditor should provide explanations of any acronyms and abbreviations that maybe used in the documents. Is this still the case? Also what, if any, are the regulations in regard to adding fees to a debt? Can fees be added to a debt after the court has approved a charge on a property. Perhaps due to the numerous owners of the debt, many payments I made were not properly recorded on the account, some were entered over a year after the payment was made! Following the Legal Charge, I paid every month until my payments were refused. I am trying to compute the over payments, but the addition of fees etc. is confusing me. Any comments and/or help would be appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This is the story...

 

My wife is 70% disabled.

 

We needed a car large enough to put her mobility scooter inside, but also automatic so she could drive it.

 

I took out an agreement which I beleived to be a Credit Sales agreement.

 

I paid a large deposit in cash and kept up the payments (honestly!) To this day

 

I still have no copy of the original agreement.

 

The salesman told me it would arrive in the post. (I said I was a fool) Did I read it? No not properly I suppose.

 

The retail company is out of business and the salesman has disappeared no matter how many phone calls I made no-one could give me any help.

 

I knew the time would come whe my wife's driveing days would be over. (She is now well over pensionable age and I am no spring chicken)

 

I decided to sell the car and buy something smaller and asked the company for a redemption figure.

 

To my amazement I found that the agreement was in fact a Hire Purchase agreement!

 

I am not allowed to sell.

 

I carried on making payments and have payed well over half the value of the car.

 

Meanwhile I started trying to negotiate with the company (Mistubishi-Black Horse)

 

They simply could not care less.

 

As my wifes health deteriorated so I could not work and so it became more difficult to keep up payments.

The company made more and more charges against me, and although I have only missed two payments they want over £2k.

 

I have decided to make a stand.

 

Yes I am an old Fool but if our marriage of nearly three decdes can withstand 23 medical operations,

I can put up a fight against these people.

 

They are threatening court action.

 

Can any body advise me. God bless you.

firstly, they have no legal powers to threaten anything, so don't worry.

 

as you have the agreement, you should have some figures in there that state the level of payment before the motor is yours?

 

if they have been charging you then fire off an SAR and get the statements for the A/C then put in a claim for them to be refunded.

don't forget add their interest rate & then add 8% stat int to that total.

iwould think that might well almost kill the balance?

No I never recieved an agreement. However the charges come to about £600, and they are late payment charges. When I wrote to them I had a reply with some figures, a reply from a firm of solicitors who are starting court action in about ten days, and a reply from Black Horse who have refused to refund charges. All of these have the same address in Cardiff, and I am wondering how genuine they are. I will have no option but to enter a defence and counterclaim if the start any action. I am well out of my depth, and worried for my wife, but prepared to try and fight for all that. Thank you so much for your reply and your advice.

right well ignore all the threats.

they wont go to court its just a clever play on words, esp their in house solicitors, yea i bet, bloke on the next desk!

 

what did you write the letter for the return of charges & did you inc interest on top.

i thought you had already sent one?

when was it sent?

 

and how did you arrive at the £600?

do you have all the statements?

 

oh and not got PPI on it have your [payment protection insurance]

Sorry DX I have not been clear. I sent a letter after letter to the company complaining about the way we had been treated. They ignored them. Finally they issued a default notice. I wrote back, questioning the figures on the default notice. They sent me an account statement, with over £600 in charges and interest. I questioned the charges, telling them that they were immoral and probably illegal. They responded by sending a solicitors letter threatening legal action, and followed it up with a dismissive letter alledgedly from the Black Horse telling me the charges were justified. All the letters, despite the leter heading were from the same address in Cardiff. I have no copy of the original agreement, (see my first post) so I have no idea weather the monthly payments include PPI.Thank you for taking trouble with me.

i would send a CCA request to black horse asap.

time you did it formerly, if they dont comply in 12+2 working days then stop payments.

 

as for the charges, you CAN claim them back.

and you can add interest to that figure [however, you cannot claim back the interst they charged you unless it is solely interest charged as a result of unlawfully charges].

 

get that CCA in, if they cough, it will also tell you if you are paying PPI.

12 working ays have come and gone. I am about to send them the second letter denying any debt. Does this mean that they are unable to enforce any agreement in court permanently?

 

You need to send the letter "Account in dispute", as they haven't provided you with the CCA. They are not permitted to take any action to enforce payment until they have provided you with it.:)

 

Should they provide the copy I would suggest you post it (removing identifiable details) so that peeps can have a look and check out if it's enforceable or not.

how long have you had the agreement

 

if you have paid more than half, you can do a voluntry termination on the agreement

 

we can sort out the charges issue also

 

after 14 days, you can legally with hold payment

 

i take it the request was sent by recorded delievery

The only problem with termination is that we will be stranded without a car, and my wife virtualy housebound. As I first said I saw this time coming and thought I had a credit sales agreement, which would leave me free to sell the car and buy something smaller and better for getting us around now the mobility scooter is no longer an option, and my income has dropped due to increased careing commitments. I have paid well over half the cost and I feel we have been treated abominably. Since the CCA request I have not recieved a single letter, demand, or contact, and I wonder if tey ever recieved a contract I know I did not. You have all been brilliant and your kind comments have helped us through a difficult time. Thank you all. I will keep you posted of developments and send the letter that Joemay suggests. I am not tht good on computers so I'm not sure how to post the agreement if it ever turns up,but I'll do my best.Thanks again.

So if they do take me to court, their default on the CCA is no defence then? However there is a good case for misrepresentation, and then there are the charges as well. I could ask my daughter to look after my wife and go to court and at least tell my side of the story. What about the Ombudsman? Would that be a viable option. I've read your thread Jogs and thank you for it. It has made me angry on your behalf, and furious about the way we have been treated.

you can sell the car and pay off the balance as long as you pay off what you owe black horse from the proceeds of the sale so dont be fooled by these people if anyone can ruin your life BLACK HORSE can they ruined mine

I'm sorry Binski. All the more reason to fight! Even if you lose you go down fighting. The more I read from all of you good people, the more this late middle aged old war horse gets angry on your and my own behalf. Maybe some one will come up with a solution,or a way of giving these **** some grief.
