Hi each and all, I will dive straight in regarding my query,

I recently "9/11/10" forwarded a request to 1st Credit for

 

1) A true copy of the alleged agreement that they refer to

 

2) A full statement of account

 

3) A signed true copy of the deed of assignment

 

4) A copy of all other documents relating to the alleged agreement

 

The letter I sent them was a template and stated all that needed to be stated

I received there reply today "19/11/10" and this is what they replied with

" Thank you for your letter dated 9 November 2010.

Further to your letter, I comment as follows

 

1) Further to your request for a copy of the agreement, we have contacted Royal Bank Of Scotland accordingly for a copy of the same. We have been advised that they are unable to assist us at this time and we are therefore unable to provide us with a copy of the agreement.

 

2) In accordance with your request , the statement of account is as follows:

a. The state of the account = £688.72 outstanding.

b. The amount, if any, currently payable under the agreement by the debtor to the creditor = £688.72

c. The amounts and due dates of any payment which, if the debtor does not draw further on the account will later become payable under the agreement by the debtor to the creditor = £688.72

 

3) With regards to your request for a copy of the deed of assignment, we would refer you to section 136 of the law of property act 1925 which provides that the debtor is notified of the assignment of the debt in writing and not a copy of the deed itself. A copy of the notice was sent on 15 July "2004"

 

4) There are no further documents

 

We are fully aware of the legalities whilst there is an outstanding request for documentation under the Consumer Credit Act 1974. No legal action will be taken and collection activities have been suppressed.

 

We maintain that although currently unenforceable, the balance remains lawful and outstanding. should a Copy agreement become available, we will respectfully resume recovery of the debt.

Hi, sorry you were missed

 

While they cannot provide a copy of the agreement, they cannot enforce this debt via the courts. they are quite correct in that the debt is still valid, just that they can do nowt.

You say the NoA was 15 July 04. have you made any payment since then?

If you are asked to deal with any matter via private message, PLEASE report it.

In that case they can bu**er off. This debt is Statute Barred and you can tell em so too.

Look in the library (top left) and the letters will be there
