      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have two loans with Lending Stream and wrote to them infroming I would be defaulting, this was at the end of February. Stupidly I thought they wouldn't take any money from my account but of course they did!. I have since changed bank accounts and written to them several times but have not had any response regarding my request for a payment plan buth have had several emails and texts offering me another loan! However, last week I received a default notice and a lengthy letter about me not contacting them and had 14 days in which to reply! I would just like to know where all these emails and faxes we send to these PDL companies end up as many offer the standard response that they have never received any correspondence even when they have been addressed to a specific person!

No nothing at all mate and to be honest i have compleatly fortgot about it, It only crosses my mind when i get a email about this thread.

 

And i am with "slgsue" on this one i will wait till they contact me.

Sorry guys, totally disagree with the ones who say just wait, we were stupid enough take out these payday loans so why not just get them sorted , I have emailed Lending Stream on a few occasions with no response, I have now got one letter ,felt guilty so phoned them, they were more than nice and now the repayment plan I wanted is in place, with just one phonecall, most of my other payday repayment plans are now sorted except for Swift Sterling who are being ackward .

 

Just think why not get it done &dusted now & wait later on, thats when it will catch up.

I defaulted with Lending Stream back in February and despite 20+ emails from me attempting to arrange a payment plan, I heard nothing from them (other than emails suggesting I take out a second loan!) until middle of May when I received quite a nasty letter advising they were going to send me a default notice due to my "refusal to make payment". I responded with a letter detailing all my attempts to make contact and again outlining my request to enter into a payment plan. I also informed them I would report them to the OFT if they continued to use bullying tactics and that I was concerned about their frequent emails offering me a second loan, behaviour which I did not find to be in line with a responsible lender. As with most people in this thread, they have not responded. I have also tried to phone them but got an answer phone message requesting I leave my details and they will call me back. They haven't. I agree wholeheartedly it is my responsibility to pay them back but they are not making it easy and I'm not using anymore energy chasing them!

That seems to be normal of lending stream my friend was having the same problems as you and i posted on here after she recieved letters from them to see if anyone could provide an email for lending stream. she contacted that email address and got a reply stating they can set up a payment plan but only over the telephone, she emailed back saying that as per previous emails that had gone un answered she wanted all contact to be via email and that she wouldnt be contacting them by phone. low and behold no reply. pretty disgusting behaviour from a company in my opinion

Anyone heard from Lending Stream yet? I have had emails from them this morning. They are passing my account onto Murky Hall gawd help us! I took 2 loans out from them - one for £200 and they are charging me £582! The other one was for £165 and they are charging me £434!

It seems that lending stream are having a clearout of some sorts, as i have heard from a few people who have recived the same sort of email this morning (that includes me)

 

At the end of the day what is one to do when you offer them payment plans and they dont reply.

 

What i am going to do is let them hand it to mucky hall i might make a full and final offer or just leave it be. As i have had dealings with them ( m.hall) before and they are full of sh..t and to be honest i cant be ars.d to start negotations with them.

This makes sense (the clear out part perhaps in the last couple of days anyhow!) you see I have a Lending Stream debt too ... well actually it's with Resolution Recoveries (their inhouse debt collections) now and they ask me to pay them instead of L.S (is this right?) I'll be making my payments after finally getting them to accept but however in recent days after logging into my account with them online, guess what none of the payments made to date have actually gone towards or made a dent in the balance!!! that's right their applying more charges!

 

I think I've been silly with this cause whilst I have it in writing their agreement to the payments I'll make each month, nothing really got discussed between us with regards to the freezing of charges (which I understand they don't have to do) neither had I asked about a breakdown of charges tbh - should/could I do this now??

 

I think this one is going to be quite tricky cause it was a 6 months loan rather then the usual payday loan ?

 

Also I'm really beginning to get bombarded with daily texts and messages of 'in connection with your recent correspondence we have various suggestions to ease your financial burden, please contact lending stream on xxxxx ??????? and think they may have sold my data on as getting a lot of other weird and wonderful texts/emails and messages

 

Please, any advice would be gratefully received !

If anyone needs contact details for resolution recoveries I do have them - you've got to keep being persistant with the emails to them as they will try to ignore

Hi there. I also received a email from lending stream yesterday. I was in such a mess with payday loans I forgot I actually took out a loan with this company and this is the first time they have contacted me.

 

I took out the loan last November and my card was reported stolen with my bank to stop funds coming out and leaving me with zero money.

 

This worked with the loan company's but with them sending me this email I am now panicking about my account. Do you think it will be safe? I'm scared that they have 'remembered' about me and will attempt to set up a direct debit (even tho they have never tried since last November) am I just being paranoid or have lending stream tried this with anyone on here?

 

I don't mind that they are passing the account onto mucky hall, I've had dealings with these before and know just how to handle them.

I think it's all to weird !! my strange text and message come through yesterday to! I think you should be fairly ok with the dd - anyhow if you spot them early you can decline/delete y'know! tho Lending Stream never set up a dd for me and I'm sure I read on here about others saying they took a long time to catch on, so couldn't quite believe how quickly Resolution Recoveries got involved in my account! it wasn't like I ever got the option to deal with L.S was just handed straight over to R.R

 

Looking back through past statements now, they have taken some odd amounts like one day they took £23.95 followed by £5.00 on same day

Another month nearly double this alone altogether...

 

What strange practices they must have!

Very strange indeed!! I'm watching my account daily just incase they have remembered me and decide to give a direct debit a try!

 

I've never received so much as a email from them until yesterday and had to get a password reminder etc to log on and find out how much I actually owe.

 

I wonder what has made them have a clear out?

Oh I can well believe it ! - working out my balance is turning out eligible! on a 2nd thought one thing you've probably done anyway but you do have a different debit card now I take it? just be careful if you've not had a change of account as my transactions were point of sale/terminal keyed ones obviously back when they had my old account details - now I pay them by so

Just received letters from mucky hall for my 2 lending stream loans. Am in two minds what to do; they're charging me an extortionate amount of interest for a couple of hundred quid but the loans were over 3 or 4 months initially. Ideas welcome :-)

I think it is best to stick to the original loan + 1 months interest.

 

I was considering just leaving it but mucky hall have been emailing me at work so its only a matter of time till the calls at work start.

 

My ariginal loan was for 220 so at 25% interest over a month it would be 275.

 

I will fire a email of to them today and i will post my reply.

 

Though they are renownd for not replying so i am not going to hold my breath.
