      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thanks for your support Stacey and everyone else's:) Yeah, it is annoying when I see people getting paid out so quickly but hey ho!!!:rolleyes: I'm just gonna put it out of my head now (like Martin said he would) and dwell on it no further until I hear something.

 

I've taken quite a bit on anyway, I'm trying to get a default removed from a Barclaycard account (settled), filling in the N1 form and sending off the £150 squid:( today, sending off an lba to Abbey for the same thing this week. I'm waiting on statements from the Abbey and filed a claim last week against the N'wide (number 2).

 

Too much do you think? I tell you what, I've never been so control of things for a long time, skint too but it'll be worth it!:cool:

Well good to hear that.......actually since you are new we have to say welcome to the site.

Willow ....like Big Col are seasoned Cobblers diehards..in fact I am sure Cobblers are stalling with us lot because they dont want our threads to end.

We give them reason to take extended tea breaks as they read our compliments about them paying out.

Tommy has a;most become one of the family although he has yet to find the same fame as Keith Jeramiah from the Barclays fold.........We meet and we talk Big Cols Cafe has become the talk of the town......taking customers even from the bigger rivals mention no names Ronald Mc..........So much is the interest Big Col is planning an extension after his payout.......of the old woman next door agrees...we think she might as she has an account with Nat West so we will butter her up to get the claim in.

All that said............I forgot to mention that you should start a thread of your own.

Cols thread is already bustling.......you may be able to post a few but only if you spend a few quid in the caff........well value for money and meet the Cobblers fan club.........its the only place to be for RBS claimers !!!:lol:

Hi there:) Yes I was a flipperty gibbett back then wasn't I?....hahaha it seems so long ago, not that long really but you learn fast on here if you spend the time. Good luck with your claim me dear!

 

As for everything Martin said.....Cobbetts LLP, please do not think that I am anywhere near in the same league as Martin and Big Col when it comes to hating you. Believe me when I say that they deserve your disdain much more than

In fact I happen to think that you are all lovely, warm-hearted and ethical people who are, infact just doing their jobs......albeit, with a little flavour of your own and not your profession's! But that said, I am a fan, maybe not your biggest (size 10 phnar phnar) but a fan non the less........now, will you give me my money?:D ......NO!!!!:o .....I take it all back, you're all a bunch of barstewards who'd probably trade in their own grannies for a latte:mad:

That's right, a cheque from Cobblers arrived this am for £3K!! Just need to check that the amount covers everything and ensure that the Bank doesn't charge me any more this month, that would just be stupidity on their part, so I am entirely expecting it!!!!
