HEY, i am new to this you'll have to bear with me.


I lived with my ex-partner for approx years where we had a child together the relationship broke down around the 07/08 and as the flat we were living in was his me and my son had to find somewhere else to live. So me and my son moved into our new house 09/08 and although it was expensive as it was private it was the only one we could find that did not require a bond (as i was not working and on full benefits) anyways after about 3 months the relationship started up again although he never moved in as i didnt want to confuse my son. Well as it happens i fell pregnant again on the 02/09 he stayed alot as i was in hospital alot of the pregnancy which included the last 6 weeks but also so did many other people basically everone rallied around to help out as you do. Anyway i had my daughter and he spent alot of time at the house but was still at his mams because i didnt want the same thing to happen as it did last time and things were working this way. I moved into a council property of june this year. I recieved a letter inviting me to attend a interview under caution 2 weeks ago as they had been informed that i was living with a partner. I attended the interview and was told they suspected me of benefit fraud for over a year?!? the evidence they had was as follows;

1, his payslip comes to my house as he did not want his parents to know how much wages he was on (he doesnt get on with his dad much and owes him money)


2, we have a joint account which we have had for years, i let him use it as he cant get his own due to credit problems and didnt see any reason not to we had our own cards and i used my own money and he used his.


3, also they said they had witness statements from my old neighbours stating we did live together, they would not show me these and when i have spoke to my ex-neighbours they didnt have a clue what i was talking about?? (weird)


4, They also said they had talked to my ex-landlord, now problem with this is my landlord gave me the teneancy in just my name and filled out my housing benefit forms saying i was living alone etc.... so surely that cant be a bad thing??


5, i have just recieved a letter this morning asking for my permission to view my joint account, do i sign this?


Wow i know ive babbled on but this is stressful stuff! i would be gratefull for any advice at all

Hi Nikki. What you need is legal advice. I'm not a specialist with this but perhaps a trip to the CAB would be the best idea. You need to get someone- a solicitor perhaps- who you could get to go to the interview with you and get some support with this.


Hopefully someone can come along and give you some definite information.
