Morning all,

 

I have just issued proceedings against Swift for refund of commission. They have defended and counterclaimed!!!!

 

However - they are in for a nasty surprise!

 

More later, but they really are in a mess now...I just hope they don't go bust before I get my money back!!

Update: 2013 Following our recent (9/7/13) hearing about Bank Charges at the Court of Appeal, and refusal to grant permission to Appeal; an Application has just (23/10/2013) been made for a fresh hearing and the Court Location is yet to be confirmed!

Yes it is the commission they paid to the 'agent'!!. Their counterclaim is marvellous and made me laugh - can't post too much but let us just say they have shot themselves in the foot!

 

We shall see what happens VERY soon.

Thank you LL for case post. I've been informed the FOS do not deal with unregulated companies, by a claims company and an independent. I'm also informed the company is obligated to work out the refund. I think a complaint to the OFT maybe the way to go for me. The broker doesn't exist anymore conveniently for Swift so can't claim on them for anything like PPI. There's other valuable posts on this thread which I am grateful for which I will draw on to make a case.

Hi all

Good luck with that Dougal - good for you!!! Does anyone know / have proof that Swift might hold back "commission" from payment to insurance underwriters out of the supposed "premium" thereby misleading customers about the true cost of PPI? I think we could be being stuffed both ways - secret commission paid to brokers and commission withheld from premium which we are misled into believing is the cost of insurance. I think this is another possible flaw in the agreements which contained PPI because the key facts are misrepresented yet again. Also the insurance company mentioned to me that they don't get any money until the end of the term which seems very odd.

Does Swift carry out their own insurance business, after all they have charged everybody £100's for indemnity insurance on Block, have they not??

SJ you are lucky you know who the insurance co is....... I have neverhad any paperwork, and there is no trail apart from it appearing onteh front cover of the agreement..........

 

nothing shows inthe disb sheet........... they ahve refused to supply underwriting sheet........ so looks like a 31.16 for that......

We had a separate ppi policy document from Sterling which was sent with the original agreement. Cost now reimbursed by fscs because of mis-selling by now defunct broker. Swift and Sterling still profited though. Where's their sanction?

Having read Landy Alert's PPI thread re Swift, it's good to know the OFT are building a comprehensive case against Swift. The contacts are david.blocksidge@oft.gsi.gov.uk and edward.allie@oft.gsi.org.uk. I will send my letter of complaint directly to them along with the reply I get from Swift.

from what I have read on here, the PPI is only for 5 years and the loan is older than that, so it will ahve expired...........my concern is the fact it is not showing on the disb sheet!!!!

remember every legal team in the country read whats on this thread,

its even mentioned in swifts directors report. just hang in there everyone they cannot last long now,

their backers are not going to keep them afloat much longer, and Swift are looking for scapegoats, ie :?: the web is closing in ???

keep the emails and letters going to the fsa oft ymca the red cross lol :!: seriously they do all add up in the long run.

off again now for a month or so must fly
