Hi All,


First time posting here but have been reading this forum a lot over the last year.


I am still confused though and thought maybe posting someone clever might have an insight :)


I foolishly took a HPI agreement with WCF in 2006. (first payment to them was around March 2006), i paid mostly on time and although missed the odd payment during a few difficult months, i always payed double the next to make up.


The amount was £5000 for the car.


I checked my own bank account records and it shows i have currently paid £6000 back to WCF already.

(plus i also think i payed twice on a friends card, but is harder to prove an extra £550)


The three years that i took the loan out over finished last year and i was gobsmack to be told i still owed them in the region of £3000!!


I refused to pay and ignored this for a while (i know silly me)

This has now appeared on my credit score to which i am most unhappy with and i want to get this resolved. I still have the car and feel that it is mine, but i cannot sell or do anything with it as they still have a HPI claim on it.


So, i have read a lot about PPI on here and am pretty sure this was added on to the loan without ever being discussed with me at the time. (i didn't even know what it was until i read on this site) I do not have a copy of the original agreement.


Following other advise i found on this site I wrote to them asking for the agreement and a statement of account, which i was charged for (i have to check to see if the cheque was cashed actually). I received the statement of account but not the agreement. I wrote to them last year stating that i was not in agreement with their view on outstanding debt and that I actually believe they owe me money due to missold PPI.


To date i have not received anything back for over a year from WCF and was at a total loss.


So today i called their "help" line. Four phones calls later, each with a 45 min wait time, i spoke with some guy in projects that said my account had a note on it saying they had agreed that i was missold ppi and that i needed to phone a company called the lewis group to get them to send the money to WCF. confused i called Lewis group who claimed no knowledge of this.


I called WCF back and they(same guy i spoke to first) said, i'll have to speak to claims, also, they claimed no knowledge of this. spoke to projects again (still the same guys(i got his name)) and he said he could not send me the note saying the account was settled and that he would speak to his manager to get him to call me. I get the feeling i'm being lied to but don't know what to do about it.


Firstly, does anyone know what are the steps i should take to get this company to respond to me and secondly should i involve a third party like the FOS or get a solicitor?


Any advise on this would be more than welcome (he he little joke as they gave me no advise)

You say you have no agreement?


To help get to the bottom of it i would suggest sending an SAR to welcome - it will cost you a tenner - but it will include ALL the info welcome have on you - including the original paperwork. This will tell you if PPI was included and how much.


Still will not harm phoning them while waiting but dont hold your breath if you expect to get the truth out of them on the phone - record the calls if you can.


Amend and use this letter template and send to the address thats on it.


Send a £10 Postal Order made out to Welcome Finance - write on the back it "For SAR Use Only" and photo copy it if you can. Keep a copy of the PO number as well as evidence.

If mortage indemnity insurance has been added to the agreement, i require all details on who this premium was paid to, and who underwrites this insurance.


If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.


If you intend to send a reconstituted copy of an agreement you must declare the reason why it has been reconstituted and if the original exists, the type of filing system or archive the originals are stored on.


If it is the case that any of the requested documents can not be supplied because they have been destroyed,please indicate;


1.The date the document (s) was/were destroyed.


2.The method used for destruction.


3.The position of the individual/individuals tasked with destruction.


I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties or charges which are invalid under the Unfair Terms in Consumer Contracts Regulations against me, then I shall be reclaiming them together with any interestlink3.giflink3.giflink3.giflink3.gif charges which you have levied on them.

As it is your wrongdoing and mishandling of my account which has created the necessity for this Subject Access Request, I shall also be reclaiming the enclosed £10 Data Protection Act subject access request fee.
