      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Could somebody please advise i want to request unauthorised overdraft fees back but unsure how to approach ....

 

Banked with lloyds several yrs , have a c card with them , in april this year i got made redundant i am now on income support , i currently pay lloyds £1.00 pm on a 6.5k c card , in june they took the minimum payment for c card out of my account without me knowing and nearly wiped me out so i set up a new account elsewhere , i cancelled all d.d etc but i forgot about a subscription to equifax which uses my debit card they applied for £6.99 a month fee this put me - £3 , all the letters they were sending i presumed were for c card so left them unopened , however i eventually opened and saw it was overdrawn and paid £20.00 in , since then they have charged me £39.00 & £45.00 plus intrest which amounts to afew pounds and is continuing , my concern is i recieved my redundancy at beginning of june which was 2K , i didnt have time to stop it going into lloyds account and i immediately transferred it to my mum , i no longer have this as i had to use it towards mortgage arrears. but because they saw the money and i already owe 6.5k will them seeing this money affect my position to claim ?

i need to sort this asap before it gets bigger and more out of hand any advice would be greatly recieved . x

After consideration i have decided to try and claim these charges back , i have drafted a letter outlining the circumstances and requesting they refund charges . if somebody would have a quick read through id appreciate it and any suggestions welcomed .....

 

I would like to request a refund of unfair excessive charges that have been applied to my account. I believe that the following charges as detailed below are excessive as they do not reflect the true cost of going into an unauthorised overdraft to the value of £3.06!!! for a total of 7 days !.

Due to financial difficultys commencing in april 2010 this year when i was made redundant i cancelled all direct debits and standing orders for the account and left a small balance in the account and believed that was how it would remain . However there was a request for £6.99 made to my debit card( via a online subscription that i believed had already been cancelled ) on the 28/6/2010 which you processed and allowed when there was insufficient funds , i am at a loss as to why this transaction was allowed as i have never requested any form of overdraft facility and to the best of my knowledge believed that if cleared funds were not in the account the debit card transaction would be refused ??? in allowing the transaction to proceed it caused the account to go into as specified by yourselves a unauthorised overdraft to the amount of £3.06.!!!

On the 7/7/2010 i became aware what had happened and proceeded to credit the account with £20.00. As the amount in unauthorised overdraft was only £3.06 and only for 7 days and i have never entered into a un authorised overdrawn position before that the deposit of £20.00 was more than sufficient in putting the account back into a positive balance .I was shocked and disgusted to recently discover that you have applied a £39.00 unplanned overdraft charge on the 02/8/2010, furthermore you then continue to apply another unplanned overdraft charge of £ 45.00 on the 01/09/10 and have applied interest in the sums of £1.06 & £0.40 in total £85.46. To add further insult when i call the collections department to discuss these charges i am advised that there will be a continuation of charges applied to my account until it is brought back into credit !!

Therefore i request that all charges and interest be refunded to the account within 14 days , furthermore the account be closed , the debit card cancelled immediately with written confirmation that this request has been actioned and any surplus funds to be offset against my credit card account. If this is not done i will proceed to make a claim against you for this amount plus interest and costs.
