I have today received a letter from Marstons stating that I owe £240 and that they are in possession of a Magistrates Court Order as I haven't paid the fine. The letter goes on to say that I have 7 days to pay the full amount as I have not paid the fine or responded to previous letters.

 

I have not received any previous letters and have no idea what the fine is for.

 

I have checked experian and no accounts appear to be in debt.

 

Is this a genuine letter?

Do I really only have 7 days?

Is there anything that I can do with regard to having no knowledge of this debt or any communication about the debt?

Is there any way that I can find out what the fine is for?

You nned to find out which court issued the fine to you. If you had not received a summons then you will need to file a Statutory Declaration and this will REVOKE the Distress Warrant and all action by Marston Group would have to cease.

hey, i too have received a letter today from marstens with no prior communication, saying i owe 298!?! i have no idea what it's for and seems as you're in the same boat please reply and let me know how you found out what the fine was for and how you dealt with this situation. i'm leaving the country in 2 weeks so time isnt on my side. any advice would be much appreciated!!! cheers

Contact the Magistrates court manager, and see if the fine is genuine.

 

If it is then only pay the fine direct to the court. They look into appealing against the fine if you were covinvicted and fined in your absence.

 

If you are leaving the UK, then you will fall out of jurisdiction of both the Magistrates court and the Bailiff.
