I have a debt that has done the rounds of the Debt Collectors, I finally wrote to the current collector with the standard 12 days under the Consumer Credit Act 1974 [sections 77-79]. The debt collector has now responded after 12 days and their letter states the following.

 

Dear Sir/Madam

 

Thank you for your recent correspondence.

 

Your letter has been passed to the appropriate department and they shall respond to you in due coourse.

 

Yours Faithfully

 

The 12 days are passed they have not complied with the request, do I correspond further or ignore?

Hi

 

Send them this letter by recorded delivery, do not sign. This will put the account in dispute until an enforcable agreement is provided. Let us know if anything is sent.

That is a copy of their complaints procedure, use it if you get any more trouble from them. The account is still in dispute until they come up with a valid agreement.

Yes - that is why the account is in dispute, they are still entitled to come back to you with a credit agreement if they locate one but really cannot do anything until they do. That is why you are entitled to make a complaint if they harass you.

 

If they do send something that they claim to be an agreement - let us know.

if they come up with a valid agreement it will be outside the 12 days time limit

 

The 12 day time limit is meaningless.... you can stop paying (if you've started to) after 12 days but they can enforce the Agreement at any time if they find it/still have it. Wait and see what they send you, if anything.
