Small Claims Court - how do I add something to an already submitted Claim please?

Advice please: I have already submitted a Claim to the Small Claims Court and am awaiting a Hearing date, but something has come to light that I need to add to my case, which is even more serious than my initial Claim. I may need to pay to have an independent report carried out as the matter now involves an item which was supposed to be brand new that I am now fairly certain is in fact my original item which has in effect been sold back to me as 'new'.

I tried to explain the above and seek guidance over the phone with the Court and they mentioned Form N244 but having looked at it, I'm not sure whether all of it is relevant i.e. questions about the amount of time the hearing will take??

I'd very much appreciate clarification on the correct procedure - I'm trying to bring this matter to Court without using a solicitor but am finding it quite difficult - nothing on HM Court website seems to be in common English!

Nettie31 welcome to The Consumer Action Group community.

 

You haven't received any replies to your problem yet so you might be better off posting your story again directly in the sub-forum which deals with your kind of situation. You will get lots of support there.

 

Also, spend some time looking round the forum. Once you understand the layout, you will be able to get best use from this Consumer Community. It is a big forumm and may take some time. But it will be worth doing.

Welcome to the site.

You will need to use the form N244 and ask for permission to ammend your particulars of claim.

Leave the box time of hearing empty.

I will try to find you a link to more specific detail.

But basically in the box which says what are you asking for write "Permission to ammend particulars of claim"

You need to attatch a revised Particulars of claim,and a good idea to attatch a witness statement.

Sign the statement of truth.

There is a fee for this.

Your old POCS should be included with red pen used to strike through anything being ommited.

New pocs should similarly include additions to the old Pocs added in Red ink.

 

You should provide 3 copies.

Dear Martin, Thank you so much for your reply and for the link to the Ministry of Justice page (I NEVER would have found that).

I am wondering whether I need to include my additional item in the 'Brief Details of Claim' on the front page of the Claim Form document, which is where I have listed 'bad workmanship' as being the main thrust of my Claim, as this new piece of information basically boils down to mis-selling (in my opinion),

instead of putting it in the 'Particulars of Claim' section which is where I have referred to, and obviously attached, my detailed letters to the company concerned and the timeline to the way they dealt (or failed to deal) with my correspondence?

 

I do hope you can follow where I'm coming from with my ramblings and are able to advise me (once again!)

Am I correct in thinking that in effect it's a bit like starting all over again i.e. I have to fill out the whole Claim again, with additions in red, together with Form N244 and any expert statement I pay for and then send 3 copies and Court fee off?
