About a year ago we were 'persuaded' by Nat West who we no longer bank with to take out a loan to repay charges which they had continually applied to a small unauthorised overdraft and which had then become unmanageable. Nat West made it very difficult for us to repay as they insisted on only accepting direct debits from their account which we no longer used which made it difficult for us.

 

Nat West have since got Apex Credit Management involved who send letters in my wife's name only when it was a joint account. We have called and written to Apex to point out the discrepency and that we feel the loan was mis-sold as we were pressured into it by the bank. They never respond to this and keep threatening legal action.

 

Can anyone advise on what the best way to deal with this would be.

Do you have any of the above in writing from NAT WEST?

 

Do not engage in any telephone conversations with Apex. Everything in writing, to obtain a 'paper trail'.

 

Had you closed your NW account prior to taking out the Loan.

The only person entitled to your Personal Finance details is a Judge not a DCA

 

Move all banking activity to another banking group if you have a dispute - your funds can be used to offset debts within the same group.

Be careful with Banking details (card/account numbers) as these can be used to take unauthorised payments.

Is the paperwork specific in that they offered the loan in writing?

 

It is not normal to close an account with a minus balance, a crafty move which allows them to continue adding charges.

 

Have you considered reclaiming those charges?

The loan was offered during a phone call that they instigated and followed up with letter confirmation.

 

Have considered reclaiming charges but haven't done it yet

If you start the re-claiming proccess this would put the 'debt collection' on hold. This may well be the best direction.
