Hi,

 

i'd be grateful if someone more knowledgeable in fixed sum agreements could have a look at the attached cca which OH received from NDR after s.77 request.

 

incidentally, OH agreed to convert original catalogue account into fixed sum loan in 2007 in order to get them to back off - if only we'd known about CAG back then!

 

most of prescribed terms seem to be there, personal details & signatures have been removed.

 

am i correct that the various charges listed under key information are unenforceable / unlawful since they didn't actually state the amount and refer to other documents?

 

NDR currently adding £12 charge every month as OH's payment (£1) less than min they want!

 

would really appreciate some help with this one.

claim those unlawful charges back too

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

you should have terms & condition for the time of opening and a whole loy more

 

see one of the many mass threads on is my agreement enforceable etc

or on shop direct

use the adv search top right

 

do a bit of reading
