DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi, Capital one refused to refund anything after prelim and LBA, so I filed at court. They until yesterday to defend, but according to the court they havent recieved anything. Should I try calling CAP1 or should I just request judgement?

Yes request Judgement-no need to inform Cap1

 

It is possible the Court will give a day or two -this is usual.

They will probably seek a set aside if judgement is entered.

Having just gone through the court process myself with Natwest, I did learn one useful piece of information.

 

Many local county courts now process certain types of claim through their nearest regional busines centre. In my case, a claim filed in west london, ended up having defences and requests for judgement handled through the Haywards Heath Business Centre, which is like 60+ miles away.

 

In my opinion its bureaucracy gone mad, but it would be worth checking if your local court handles the claim itself.
