I have recently purchased some flooring from Floors To Go which i have no yet received as it is still on order.

Can i cancel this order and get a full refund before i receive the flooring.

What are my rights?

When was you told to expect delivery ?

I mean how long has elapsed between order and now ?

What communications/response has there been in this time ?

I was told delivery would be about 10 days.

The order was only placed on Saturday afternoon and since 14.00 Monday i have been trying to cancel the order by phone and sending e mails which i am still waiting for replies on.

Generally, there is no legal requirement that goods are delivered within a particular time. All that the law says is that goods should be delivered within a 'reasonable time', which is a matter of debate. If necessary, you should consider setting a firm date for delivery, and incorporate this into the contract. Ideally, you should make sure that a specific delivery date is written down on the order form. This is called 'making time of the essence in the contract'

If there was an agreed delivery date at the time of ordering and they did not meet this,then that gives rise for you asking for a refund.

I saw floors to go terms and conditions but only those relating to orders online.

They may well say that you need to pay a charge for cancelling-have you looked what it says on the invoice ?

Either way I would go back to their counter rather than try to deal by phone.

If they do say that they can only refund XXX and that there will be an Admin charge for cancelling,then at this point you can demand they substantiate that charge to demonstrate it reflects their true costs/loss,

Welcome to The Consumer Action Group.

 

 

I am just letting you know that as you haven't had any replies to your post yet, it might be better if you post your message again in an appropriate sub-forum. You will get lots of help there.

 

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.

 

 

Once you start to find your way, you will soon realise that it is fairly easy to get round and to get the help you need.

 

It can be bit confusing at first.
