Capquest stat demand court dat ebut no response from capquest

After receiving a stat demand letter from Capquest and reading the forum I wrote to them asking for the original agreement , notice of assignment etc.

 

I received a reply saying that I HAD been making payments towards this debt BUT they were happy to now cancel the Stat Demand so ignore it ?

 

Of course I went to the court and filled out the application to have it set aside - the court date is Nov 9th and although I intend to turn up and tell the judge that I have NOT received information asked for , the SD was not served properly etc is there anything else I need to do ?

Sounds good Bazooka (!!) - should I be contacting capquest to tell them they have not sent me anything / tell the court etc ?

From what i have read on the forums, and from my own experience of CQ, they are full of it. They will try and bully people, then back down when faced with someone who is prepared to stand up to them.... bullies and cowards. However they do scare and harrass people who have not yet found this site....

The courts and the OFT are getting rather fed up with CQ and 1st crud using the insolvency service as a debt collection tool, allegedly.

 

Stand your ground and claim for exspenses as an LIP. Approx. £250 is the average on here

Capquest have gone a little quiet now so think it is about time you reported them to the OFT if you haven’t done so already.

 

 

Please bear in mind that the template letter on the first page of this thread:

may not be suitable for all and you will have to adapt it to your own circumstances I.E

You applied to get it set aside and CQ didn't turn up

You applied and CQ agreed to discontinue

You ignored and CQ did nothing

 

 

Today the OFT set out some new guidance and sending SD's as a debt collection tool is now frowned upon.

You can complain by email and the OFT will email you back a form to sign and post back to them for them to be able to add your complaint to their list.
