first i hope i am posting in the right place!!

 

so heres the tale- my mum had her driveway monoblocked last february, but the drive is not even no straight lines, no drainage beside garage door.

it is not right at all.

(she unfortunately ended up very sreiusly ill in hospital hence the reason we are just ableto deal with this now).

 

anyway she has contacted the person who did the drive and he said he would send someone to fix it, which he did but the man took one look and said this is not a small job the whole drive needs lifted and relaid.

and because he was told it was just a few hours work he was not willing to undertake the job as it was too big.

my mum has ried many times to contact the original trader but he will not respond at all until.....we have been to trading standards who advised us through a process of sending letters etc which were sent recorded and he never picked up!!!

so then we have gone to phase 2 and had trading standards officers actually go to the house to which they couldnt enter as the gate was padlocked??

then my mum receives a very rude phone call from the trader shouting and swearing at her down the phone and in the end up he said he would give her the money back.

which he has not done!! trading standards then called him and he said his company was dissolved and he had nomoney to pay.

we checked out companies house and right enough his company was proposed to strike off but we sent a letter to them explaining the dispute and they have accepted this and suspended the strike off for 6 months.

 

what we need to know is should we go through small claims for this and how likely is it that she will get the money back (£2160, plus she paid for the materials) or do we have to push through the sheriff courts in orderto get somplace, this boy is very dodgy and is taking cash in hand and not declaring vat on his invoices its getting to the point now we will do anything to make him pay one way or another which is spiteful i know but this is so frustrating and it could be over in 5 mins if he would just stick to his word.

The poster said struck off - this is different to liquidation. It might be that they haven't filed any accounts and companies house are striking them off for that.

 

To the OP. Only bother suing if you thing there is any money to be had. It doesn't sound as if there is in this case.
