Hi all!

 

I'm currently trying to get off the roundabout that is payday loans but I'm encountering some problems...

 

1 - I owe cheque centres £700. They want me to pay them back at £100 per month. They have frozen all charges but £100 pm is going to cripple me. If I could afford £100 pm I'd have carried on rolling it over!! The main issue with this one is they are threatening an AoE. What's the process for this and how long does it take? I'm thinking of telling them to go for it as I'm currently on maternity pay anyway!!

 

2 - Moneyshop - I borrowed £1000 and the repayments are £100 pm. For 2yrs. I've paid them £1400 already but they are unwilling to help. Keep sending me recorded delivery letters too.

 

3 - Harvey and Thompson - they are owed about £500 and sounded like they would agree to reduced payments so not a problem so far....

 

4 - cash converters - I owe them £660. Strangely, they have not contacted me for a couple of weeks....

 

5 - pduk - they are owed £212 and I've not heard a dickybird off them since the day after I defaulted on the

last month.

 

6 - Albermarle and Bond - I owe them £700 in cheques. I haven't got a clue what to do about them. I'm trying to rollover and reduce each month at the mo.

 

It's the cheque centres one which is worrying me. They have asked for my debitcard details but it will be a cold day in hell before they get them!! They haven't mentioned even going to a dca, just threats of AoE straight away. I tried to call their bluff saying they couldn't just do it and needed to go to court etc and that's what they said they'd do.

 

Is there anyone who could shed any ideas on these for me?

Well, I took myself to cab this morning and showed them my workings re pro-rata payments etc and they said that as it was only a short term problem, then just to speak to my creditors. Will start getting letters etc sorted out today.

 

Anyone have any other advice?

To get an attachment of earnings they would have to have a CCJ first, and these can be easily defended against them due to high interest rates. The CCJ would need to be granted and defaulted on before an AoE can be placed.

 

Some of these morons think they can call your payroll people and have it done 'just like that' but that is not the case.

Hi Kitten

 

I think you have to be more realistic with your payment schedules and negotiate. Are all the cheques you have issued guaranteed? If so you may have to consier switching banks and come to an arrangement with your old bank to pay them back when they honour the cheques. To be honest better off owing a bank I suspect. If not guaranteed you can just cancel the cheques.

Yeah Robjam's suggestion seems the best with cheques....banks are a lot more understanding than these companies. The only problem with the banks is that they charge £15-20 for each one they process that bounce but have to let through...

 

but i think this is still less than what most of these payday companies charge....

 

whatever you do try and get a payment plan agreed asap so you dnt have to go through the hassle of dca and court

Hi agree with cooldude and robjam, I also sympathise as I have been through this, and only just getting over it now, (although I do have a problem with one such company). They only thing I wanted to add was in relation to PDUK - a year or two ago I agreed a payment plan with them over three months; the final payment was to be £313 which they were supposed to take out of my account - wierdly, although they took the two previous monthly installments, they didn't take the last one - I was so skint I didn't chase them, but neither they nor any third party has ever come after it - and I have not changed my home address or anything. Actually if they got in contact now I am almost out of the trap, I would pay up, but there isn't any mention of them on my credit file so I am not minded to correct what looks like their own internal error. . . . hopefully you will be as fortunate - and best of luck, honestly the payday trap is a nightmare - I would rather it were simply illegal

thanks sillygirl, you confirmed what I thought.

 

Luckily, only A&B have cheques. The rest are loans. I have done my letters and worked out repayment schedules for all of them so I will be debt free by Xmas next year. Not bad really.

 

I will concentrate on cheque centres, h&t, moneyshop and cash converters for now.

Pah!! Talk about bullying tactics!!

 

Despite me writing to cheque centres and asking for contact only via letters, I got a phonecall today off some bloke who claimed to be in the legal dept. According to him, he can phone if he likes and if I refuse to take the call then I am not cooperating re my debt. They, apparently, don't have to accept any form of dmp and, as I said they wouldn't be getting any bank statements etc without a court order, he's saying they're gona go for a ccj. Fine. And it would increase my debt by another couple of hundred quid.

 

Bear in mind, I had my screaming 3mth old in my arms at this point so I just kept telling him to put everything in writing. He refused saying something about them only being a telephone company? He then proceeded to offer me a settlement figure of £450 for a £700 debt. I said put it in writing and I would see what I could do.

 

He kept referring me to all kinds of sections of the oft guidelines on debt collection but I think he's not expected me toread them!! They say that they must not engage in unfair practises but surely what he did would be classed as such?

That's the first issue. Then, he all but accused me of fraud in how I got the money and told me that they wouldn't deal with a debt management firm. He's told me to speak to a solicitor about my contracts etc.

 

All the other companies have at least started to write to me and agree repayments. This company are particularly persistent and causing me some stress. What can I do tho?

firstly dont worry, they will not take you to court, they dont have the man power or the knowledge of the system. i have really only seen relatively small lenders take ppl to court. You dont need to take things to a dmp and rather give them your payment offer and ask for their bank details so you can set-up a s/o. if they want to talk to you on the phone and you think it might help them accept your offer you can agree BUT have everything confirmed in writing and make sure never to give them your details.

That is reassuring but he refuses to put anything in writing as they are a 'telecommunications company' whatever that means. I have never refused to speak to him but he is persistant and rude. I told him today to take me to court and he started waffling about how that was worse for me. Who cares bout my credit file? It's knackered anyway!! I told him I had approx £3.5k worth of debts which, with my plan, would ALL be paid off completely in just over a year. I don't think that is unreasonable personally.

 

He really thinks I'm an idiot. Maybe I should speak to a solicitor about HIS unfair treatment!!

i wouldt bother. he wont take you to court and the whole telecommunications thing is bull****. tell him to stop wasting your time and either except an agreement and confirm in writing or take you to court. maybe try calling up the creditor and speaking to someone else?

Yeah, I think I will. I phoned them the other day in response to a text and the bloke I spoke to discussed it all with me without me going through security!! Naughty naughty!! He was actually quite human but then he wasn't my 'case manager'!! Shame I never got his name......

 

Failing that, I intend to find an email address for this 'person' and send him my repayment schedule. I'm intending on going into the local branch and I'm going to make the payments I am proposing. At least then, IF they do go to court, I can show I have made an effort. They will then look bad for not working with me!

Cheque centres, whilst refusing to make any kind of arrangement with me, are carrying on adding interest to the loan of 8% per day!! I'm never going to be able to pay them back!! I've told them to take me to court but they won't as yet!! Feel like I'm banging my head against a brick wall now!!

I'm kinda hoping that he'll back off a bit this week as I should be able to dredge together £100 as a starting point towards this debt. But, I'm gona tell him that unless he agrees to a payment plan, it's going to one of my other more cooperative debts!! He who shouts loudest, doesn't always get'n

would like to know how you got on with this..I reckon ive been talking to the same guy today based in edinburgh telling me in his words how i got the money was fraud and i can look forward to a wages arressment and he will personally deal with the case to make sure im done for this? he said you cant take out a loan and within a week find yourself unable to repay it and what i done was fraud...im a big guy but he sure got to me...this was the cheque centre. guy btw

Only just seen this.

 

Basically, I managed to get hold of his email address and emailed him with a repayment plan. I had written to them but he was having none of it. I now just pop into the local branch and make payments.

Report Chequecentre to the Office of Fair Trading and Trading Standards, he is talking a load of bull, do you have an email for them, because the tactic to use against them is to email every time they call confirming that you do not want calls, will discuss on paper or email only and are not avoiding paying them.

 

They do like to make out they are more important than they are 'legal' in this sense probably means he is a customer service bloke working in the 'legal' department to threaten people into paying more.

 

Report them and if you do get another call tell them it is being recorded for evidence that you do want to communicate but not by phone as there is no permanent record....
