AIUI they have got the fact it can only be on that side correct but the box markings have to extend to the corners/kerb.

yes, unless they have special dispensation from the HA to deviate from the directions in TSRGD for that site.

Yeah I meant the Dft. But even so, the point still stands - TSRGD, unless they have dispensation. If they don't the non-compliant markings are completely unenforceable.

 

Chances are they just bodged it up but there is always the possibility, as with any signage or markings which doesn't exist by the book, they have specific approval to use the marking (and will prove so if the ticket is appealed, probably).

Seasonal greetings to everyone. Links to My letter and haringey's reply attached below...Should i proceed to appeal and is the statement on my letter enough grounds for the appeal? Does anyone here think differently?

They seem to be missing the point somewhat.

 

It does not matter whether or not you entered the box or not. If the box is not compliant to TSRGD's regulations, the box is not enforceable and unless they have special dispensation to install something else, they cannot enforce tickets where the installation is not compliant.

 

Also, they are quoting the Highway Code when what they should be quoting is Regulation 29(2) which does not say precisely the same thing as the Highway Code - another example of where even official paraphrases can be misleading.

 

Two corners of the box (where it covers half the road) have to touch the kerb. As this box only covers half the road both corners on the kerb side have to touch the kerb - from the aerial photo this does not appear to be the case, so the box does not comply regardless of whether you broke the rules, they cannot enforce it.

 

I would suggest - even though it's a third party site - having a look at http://www.ticketfighter.co.uk/yellow.htm - it does contain the relevant legislation and the diagrams showing what is permitted from TSRGD.

 

As they are too dogmatic to realise this I'd certainly take it to PATAS but be careful - if you lose, you lose the lower rate on the ticket.

 

I'd be inclined to give green_and_mean a nudge if you want to do this - he has plenty of experience of dealing with PATAS.
