    • okay, perfect and thank you so much for the help once again. so firstly i am going to initiate the breathing space, during this time it's likely ill receive a default. when i receive the default are you aware of how long it will take for me to know whether the OC have sold it off to DCAs? Once it's with the DCAs i do not need to worry as they cannot issue a CCJ only the OCs can Even if i decide to come an arrangement with the DCAs no point as the default will remain for 6 years paid or not paid I should only consider repayment if the OC still won the debt and then issue a CCJ? Just to confirm the default will not be seen after 6 years? No one can tell I had one then after 6 years ill be all good?
    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share. 
    • To re-iterate and highlight my urgent question on this one: The N24 from the court did not include any instructions to submit paperwork 28 days before the date, unlike the N157 received for other smaller claims. Do I have to submit a WS for this court date? Link has!...
    • No, reading the guidance online it says to wait for a letter from the court. Should I wait or submit the directions? BTW, I assume that the directions are a longer version of the particular of claim accompanied by evidence, correct?
    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Wonder what your advice would be given the documents they have provided? I am now in a position to clear the debt either by lump sum or a few large installments - Is this something i should look into at this late stage? Thanks as always in advance

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

several months ago, I contacted picture over the phone

requesting certain information regarding the ppi we took out with them in 2006.(insurance documents/ paperwork , you get the picture.:-)

 

They informed me that they have nothing to do with the insurances anymore, and that a company called ,

The warranty group(TWG) deal with all these issues.

 

I contacted this company, and they informed me that

PICTURE deal with all insurance, ppi queries:???:

 

I/ we have had enough of this company giving us the run around and so i have contacted the (fscs) and they

have sent out an "initial enquiry questionaire" form which we have to fill in and send back.(so far so good)

 

with regard to question 2; its asks;

Please provide details of the firm you are claiming against. please make sure you have given the advising firm and not the product provider.

 

so is it just "picture we put down in this section; can someone please clarify,,,... cheers.

The reasons why we are going to put a claim in are as

follows; and do we have a case;"comments please":-)

1- secured loan 20 years,(ppi only 5 years)

2-had no choice. no ppi no loan.

3-I was self employed,(have been since november2002)

4-SINGLE PREMIUM(all intrest loaded up front)

5-No other insurance was offered;

6-No demands& needs;.(on either of us)

 

7- we would like to reclaim all the ppi,plus the intrest,8% i believe and bring down the payments and put the loan back to how it would have been without

ppi. "thank you"

well since completing the "initial questionaire", we have now been sent another claim form which we are in the process of completing;but this form has to be sent to Delloite LLP.

I/WE know this may take some time to get sorted out, so we will just have to be patient:-)

would just like to ask for some advice/feedback regarding the following;

 

1 -why is ppi such a "no no" when/if you are self employed:?:(i have been since 2002)

2-if you already had a life policy in place(we did),would this make a difference to ppi being added to

ours/ anyones agreement:?:

3-all of our dealings with picture were done over the telephone,"does this make any difference".

Any help/ advice regarding these issues would be greatly "appreciated" by both of us:-)

hello. , just want some help/ advice if possible.

at the time of taking out this loan, the insurers were (2006)

1 - combined life assurance company limited,in respect of life,accidental death,disability and hospiltalisation cover;

2-london general insurance company liimited in respect of unemploment cover and no claims bonus.;

BUT in 2010, we have a letter stating that, TWG( The Warranty Group), were in fact the insurers (insurance company)

 

Now in filling out the compensation form,(still going through it),section E3,

IF any body has filled this bit in, we would like somehelp/advice what to put down in this section.

DO we simply put down all of the insurance companies down & hope this is correct.

If Any body can help/advice in the completing of the FSCS compensation forms & any of the above,

also regarding previous post/posts this would be very much "appreciated"

update;

have finally sent & completed compensation form to "Delloites",

 

we have recieved confirmation letter from them to confirm this.

 

"all systems GO"

 

We would still like to ask if their are any,

 

,Picture,Picture Home Loans(now Webb Resolutions), experts/ gurus for any comment on this thread;;;;;;;;;;

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

WHO should we be using then? ,,,dxany expert/guru who has had dealings with "Picture" willing to comment thanks again , happyhamr

 

Do not use anybody else !! They will [problem] a big percentage off you with various charges and admin fees..Picture went bust last year or 2009 cant remember which which is why it went to FSCS..I went through them myself , filled in the questionaire basically stating that I was missold as told I had to have the PPI and not given the chane to seek insurance elsewhere.Took about six months in all but got £8k back .I think you do not get the full amount of PPI but 90% up to a certain amount.Please do not use claim companies..FSCS were great I just rang them on a monthly basis gave them my ref number and they updated me.It always goes through Deloittle first...

we are not using any other claim companie(s).we have filled in compensation claim form fscs,& this has been sent to deloittes. this is the procedure"we thinks"hope this "clarifies" situation.thanks jj69& dx; (sorry for confusion)

lol thats the procedure I followed , waited about 3 months but got the result I wanted.As you can tell I loath claims companies young girl at work chose one she had to pay £320 up front and she did !! Of course as you can guess no PPI was refunded oh and they kept her fee.I told her how I had claimed which had cost me the price of a recorded letter.If you dont hear any news say in two month period give them a call for an update , sometimes it jogs them along a bit ..
