A debt collector has turned up out of the blue claiming I owe them money. Please can anyone help??

Basically a few months ago I received a strange letter which had no company heading and merely said can [My name] contact this number. In all fairness I thought it was a [problem] so I binned it. A few days later I received a call at my house asking if I was [my name] I asked who was calling and they were very ominous, so I put the phone down. An hour later I received another call saying the male caller was from a company called Thames credit Ltd who were trying to contact me over a debt I owed their client. At this point I spoke to them and discovered the debt they were asking for was for a company I paid a long time ago in an Administration order to the court. I explained this to them, they insinuated I was lying so I quoted them the court case number (it is available to the public records but clearly they don't check those!) and told them to enquire with the court and to get back to me when they had done so. I received a letter from this company apologising and that this debt would be written off as it was clearly an error.

So it should have ended there. A few months later I received another letter, this time from a company called Robinson's way Ltd, the letter merely stated I owed the above balance and did not include any reference to what this debt was for and suggestive threats of legal action, so assuming it was the same debt from before, I rang them up in good faith, and told them the same quoting the Administration order details (I have a certificate of satisfaction from the court over this) Anyway this company were more verbal interrogating and again were insinuating I was lying.

 

You can imagine after 6 years of silence over a matter that was upheld under a court I am not happy about this resurfacing again as I feel I have done everything correctly and in line with the courts and the creditors were paid what they accepted from the court at that time. Robinson way said they would check this out and I heard nothing more so I assumed it had been sorted. Now I have received ANOTHER letter from an agent working on behalf of Robinson way called CCS COLLECT (797 London road, Thornton Heath, CR7 6YY) This letter is a Notice of Intended Legal action??

On what premise they feel they have grounds to take me to court I do not know, nor do I understand what payment is they claim I owe them. I have contacted the County Court who dealt with my Administration order and they have confirmed that the order was SATISFIED and that NO CREDITORS DISPUTED in the 16 day period.

 

So, is there something I am missing here some technical hitch that has allowed them powers over a judge. Not really sure what to do, I have to this date not responded as CCS have literally given me a 2 days to settle this account before they intend to take me to court (so they claim) I am not paying anything when I am not in receipt of any proof I owe this company anything and past what was cited on the Administration order I have had no further accounts with Robinson Way Ltd client to owe them anything.

 

Can anyone advise? are they trying to take me to court for an account twice? Can they do that? and seen as debt collection agencies have involved themselves have they now placed a default on my credit score over monies yet to be proven I even owe them. Have you have heard of anything quite like this before. I am disgusted.

Welcome to the site.

From what you say,all these companies are breaching regulatory guidelines,and their actions are tantamount to harassment.

You should contact your trading standards to report them.

Before this you will need to have some proof that they have been informed of the fact that you dont owe anything-so that needs to be done in writing.

If they persist after that report them with supporting documents.

I would report them anyway-but as said TS will want some proof that they have been made aware and still continue to demand payment.

Should they file a Court action,they will have a duty to prove that you owe the money,and from what you say your defence will clear you.

Its very unlikely that Court action will commence.

You do however need to put an end to this-and bring their actions to book.

There are letters in the CAG library (debt collection) which you can access from the drop down menu.

Meantime dont be tempted to deal by phone,keep all their letters together,and copies of any you send with proof of delivery.

Suggest that you send CCS details in writing (recorded delivery) that the debt was satisfied. Tell them that Robinson Way/Thames credit have already been given this information several times already and that if this harassment continues you will report this behaviour to the OFT.

 

If they take you to court, they will be wasting their time/money and you could get costs awarded against them.

We could do with some help from you.

Absolutely incredulous! What a total bunch of inept willy waving idiots. (Love that phrase, think it was cerberusalert who said it?)

 

Complain Complain and Complain some more, they really do need a damn good shoeing, I will do a little squirt of wee in my pants if they ever attempted court action, the amount they would be forced to pay in damages would pay for a holiday, muppets.

And please tell me they haven't been leaving incorrect adverse info on your credit file? £1000 minimum per incorrect entry! If you take them to court and sue for damages.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Who has actually recorded the defaults on your CRF ?-what date is shown there as default date and also last update ?
