Argos - Past the 12 months warranty

Hi all,

I purchased a microwave from argos in july 2009 and now it stopped working. Changed the fuse and still not working. Taken it back to the store and they said the warranty is only for 12 months. I knew that under european regulations the warranty on electronic goods is now 2 years. Am i correct?

Also browsing through this forum I learnt that I may be able to claim back under the sale of goods act s. 14, as item not fit for purpose.

Any advice would be welcomed as I haven't got much experience in this sort of matters.

Also does anybody know which address to send any eventual correspondence?

regardless to eu laws they dont apply neither does the warranty period

 

your claim is under soga

it has not lasted a 'resonable time'

 

it should be repaired FOC.

 

we have argos on board here

i'm sure one of the reps will contact you soon.

Our lawnmower packed up when it was 14 months old. It had 1 1 year warranty. Took it back to Argos who initially objected but when I showed them a print out of the EU legislation and proof of purchase they stopped arguing and replaced the lawnmower.

the same as a curry's etc

 

sadly they actually know very little so cave in on even the wrong consumer advice.

Just to clarify to DX and others, whilst I work for Argos I do not represent them. Anyway onwards:

 

When a directive is enforced it is brought into the UK via one of its own bills in this case the EU law was implemented into the Sales of Goods act 1979 (As amended). This can be found as part 5a (S48A-F). There is no two year warranty period within the UK, you have six years for a retailer to be liable for goods this does not mean they must last this long. (They must last a reasonable amount of time).

 

Under the SOGA79 Argos are required to repair or replace the item subject to the goods not conforming to the contract at time of delivery. Basically it must be a manufacturing fault and not one caused by misuse, accidental damage or fair wear and tear.

 

Statement to say to argos

The microwave is not of a satisfactory quality as the product is not durable s.14, as such you require a repair or replacement, without significant inconvenience and within a reasonable amount of time s.48B. The fact that the product is outside of the warranty you set is meaningless, warranties are in addition to the statutory rights I am entitled to, not a replacement of them. There is no requirement to provide a warranty on the product, as the retailer is responsible for the conformity of the contract for six years within England and Wales regardless.

 

Notes

They can ask for an engineers report at your original cost

Blitz, Argos can be easily challenged in a court of law and they would lose and most retailers know this which is why they would rather replace the goods than face court action .Granted in a lot of ways our SOGA is better than EU law but the 2 year warranty saves a lot of arugument in a store as once the 28 day period has passed you always have an uphill battle for a repair or a replacement. As for 1 year you stand vitually no chance on either a repair or replacement without a long uphill battle. We continue to shop at Argos although now we stick to known branded goods due to Argos customer servcie and refund/repair policies.

A woman defeated Curry's in Court. A washing machine went wrong after 18 months and because of the 12 month warranty having expired, they basically laughed in her face. She argued the machine wasn't durable and the Judge ruled in her favour. It's great when smug companies like Curry's lose!

there is NO 2 year warranty, i wonder which part of that your not understanding?

 

its all tied into the SOGA as stated above. i work for staples, i get this crap thrown at me daily, i have a 2 year warranty, YOU DONT!

 

however as you are covered under the SOGA if it is proven to be a manufacturing fault and not customer damage you will get a replacement or refund.

Obviously you seem to have a lack of understanding of EU law and SOGA! Obviously you would state that as you work for a retailer and are bias. Why do companies cave in when pushed to the limit if there is no 2 year warranty?

its called customer service.

 

and besides we always give the customer what is statuorily due to them.

 

one customer came to me this week spouting he had a 2 yr warranty on his laptop demanding a free replacement becuase it was no longer working, he demanded his EU rights... i declined and he said he was going to sue me! awesome!

 

i then casually reminded him that if it was proven the machine had failed due to a fault not caused by him we would repair or replace as appropriate, he went off on one saying he had rights to a free laptop.

 

this is the kind of ignorance we as retailers deal with on a daily basis, its all well and good knowing your rights, but theres a difference between knowing your rights and mis-interpreting them!

 

funnily enough i did him a favor and sent it away to our repairer, it came back as customer induced damage! funny that.

 

let me say it slowly again for you....THERE IS NO 2 YEAR WARRANTY!

THERE IS A DUTY OF CARE, thats a whole different thing.

 

some retailers are obviously naive and dont understand and cave in through stupidity and self perpetuate this nonsense floating around the internet that suddenly people have 2 year warranties.

 

last month some customer tried to tell me he now had a 6year warranty thanks to EU law? ofcourse you do my friend.../soothe

 

again its a DUTY OF CARE not a warranty. entirely different things.

naxxas please remember that although your posting personal opinion by stating you work for a company a post may be taken as an opinion of that company

 

it should have been mentioned in training and im sure that head office would not be best impressed by your stating that a customers opinion is "crap" in fact people have lost jobs over less

 

it might be an idea to put something in your sig distancing your own opinion from that of a companys

 

ill point out this silly thing of only posting sigs if theres over a certain ammount of letters in a post means that mines not been posted but the points still valid
