Swinton Insurance - problems with Gas boiler

Swinton is basically ins administrator and agents. I have 4 ins policies with them. I am in the process of going FSA for their Home Emergency cover carried out by HOMESERVE sub contractors. The engineer from homeserve are pointing the fault to UN-insured area like Boiler and CH that is not necessary at all. They will offer to do it for you £470 and until this is done your boiler will not be repaired. I called in my boiler service eng who pointed out from the sample of CH water the power flush was not necessary but it is the Gas valve & over flow valve. Since Homeserve and Swinton would not budge I had power flush done at £300 and I still have no HW & CH. Now only the Homeserve will send the engineer. But I have to recover this £300 cost they compelled me to do otherwise no engineer came for one month.

I will not renew any of my ins with SWINTON as they are not helpful at all. They will ask you all the questions to get more business then they will tell you to ring another phone number which is always wrong department. Their sub contractors will take you for ride in case of CH HW Boiler repairs after they have paid you one visit with fake spare part that will work for few weeks then they will point the fault to uninsured area like you need to power flush your CH and boiler system. They will quote you like £400 special price con. Until this is done their enginneer will not repair the boiler. Then if you ask your boiler service engineer he will probably tell you don't need to waste £400.

Aren't they know as Swindles? I had dealings with these people about 15 years ago and since then avoided them like the plague. Seems that they have not changed.

It looks like they operate like SWINDLERS gang with plumbers, builders + sub contractors. They just pass the buck. I need to recover the £300 cost for the CH and Boiler power flush that was not necessary as the fault is with boiler's gas and overflow valve as before as pointed out my boiler service engineer. We told them our system is drained every year boiler service and this year twice as we relolcated bathroom & kitchen with new type radiators. But they would not budge for this uninsured exclusion more than one month until we spent £300 on POWER FLUSH tests showed that our system was very clean. I have the invoice and will be grateful if any body legally can help me to recover this cost.

Recovery through the small claims is an option and will rely on having a good cause of action with supporting evidence.

If your policy is with Swinton (and its them who you are paying for your Policy),then they are responsible for third parties and their agents.

Ultimately they have a duty of care to you.

Have you been dealing with Swinton at higher level to try to resolve ?

Once you believe that you have full supporting evidence,which would include some written responses from them or their agents refusing to give you your money back,then you would need to serve them with a provisional request for refund,followed by a Letter before action.

There may be something under CPUT to look at using too.
