Hello, I'm sorry if this question has been asked before and I did try a search. I have recently received a letter from Lowell informing me that they have purchased a CCJ that I have from CL finance. A few things I wanted to ask. Firstly, is this even possible? Secondly, if it is possible can Lowell then take further action, i.e. charging orders, balliffs, attachment of earnings etc? As they say that they have now obtained my credit file. I received the CCJ in Jan this year and I never received any paperwork prior to getting it. I have had my head up my a**e for the last year and have not got around to dealing with it, is there anyway for me to dispute this as I never received any initial documents? Thanks for your help in advance.

Hi and welcome to CAG.

You may have shot your bolt by leaving this as long as you have.

As you didn't receive the court papers, you "could" get it set aside. Have you made any payment towards the CCJ?

If you are asked to deal with any matter via private message, PLEASE report it.

Thanks. No, disputing the CCJ isn't really my major concern and I haven't made any payments as I have been out of work for most of this year. I am more concerned about Lowells legal rights in pursuing this debt further. I am currently involved in a transfer of equity on the property that I am living in presently and do not want Lowell to come blundering in and disrupt this. As it is my intention to declare myself bankrupt once the transfer has taken place, my ex is buying me out of my share.

no they casnnot 'buy' it


they must be named on the ccj to enforce it


so thus they must go back to court



please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

You might want to get more info. re: BR and transfers of assets before going through with it.
