    • I spoke to a pro-bono entity this afternoon.  They advise I must initiate a claim in the court v the receiver if I want to then file an application for an order for sale.  I must have a claim/ proceedings to be able to force a sale. The judge in the current proceedings  has told me that I cannot force the lender to sell and the lender cannot interfere either.   If the receiver isn't acting correctly and isn't selling - this means I must make a claim against the receiver
    • Thanks Dave It's not too far away, about 8 or 9 miles, so I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.
    • As they have failed to deliver their original PCN you will need to send them an SAR where they should provide that PCN. It should show the address they used . If it is not your current one that would explain the non delivery. If it was correct then perhaps the Post office messed up. A more cynical view would be that UKPC didn't send it so that you couldn't claim the reduction. It appears that UKPC have been there for some time  but I have been unable to find any pictures of their Notices.The leisure park itself is pretty big so while some parts maybe give 5 hours free parking other parts may have restrictions like permits. I haven't been there for years -I went  to Nandos and the bowling centre . I am surprised that they are now infested with UKPC as the place is plenty big enough not to require their dubious services. If you live not to far away it would help if you could get some legible pictures of their signs. Be carful to park in an area that doesn't require a permit and take photos of the entrance signs, the five hour sign and the permit only sign as well as any other signs that are different from the previous signs. Also if their is a payment machine could you please photograph that.
    • This other entity doesn't know what's going on.  To be clear I had huge equity.  No-one would ever expect a lender to erode all my equity.  The question is - if anyone knows the legal answer - on the basis they have a charging order - could they make an application for an order for sale?  
    • Is this place near to you? I ask for two reasons. If you can easily go back, then get photos of the signs.  On GM and Parkopedia there are various comments about the signs being pants. Also go back to the school uniform shop and ask the manager there for contact details for the retail park (which I've Googled & Googled and got nowhere).  The school uniform shop will just be tenants of the retail park, they won't be able to do anything.  It will be the retail park that called EPC in, and we've seen loads of cases where the organ grinder has intervened and called off the monkey.  As for EPC, aye, ignore them until LoC stage.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am trying to get a little advise on how to deal with arrow global

 

 

I have asked arrow global for a copy of my cca and received a letter back saying they cant provide me with a copy

saying that they are not the original creditor

 

 

I am confused because I was led to believe if they took over the debt from MBNA

they were responsible for providing me with a copy of my cca

or do I need to write to MBNA for a copy of my agreement

 

 

who is responsible for providing me a copy of my cca

 

 

any help would be gratefully appreciated

adding in the following:

 

If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties.

Hi and thank you for such a quick response to my post I

arrow returned my £1.00 fee after sending the cca request

saying that they couldn’t provide me with a copy of my cca

I then sent the letter of dispute to arrow after waiting the required amount of time 12+2 working days

they replied saying that although they still deny being the creditor

they will suspend my account until further notice

what does that mean to someone like me who has no idea how these things work and

should I contact them again

I belive Arrow should obtain it from MBNA.

 

Did you enclose £1?

 

If it is past the 12+2 days you should send them the 'account in dispute letter'. It's in the forum library.

thanks molly i had sent the account in dispute letter and have been told by arrow today that the account has been suspended what ever that means

I might be tempting fate here,

 

 

my OH had a very similar situation to yours a few years ago.

No CCA was ever produced and the account was put in dispute.

 

 

Arrow passed the debt to a DCA and it eventually ended up with Bryan Carter Solicitors.

 

 

BC sent hubby a letter asking him for the details of any defence he would use if they took him to court,

obviously fishing for the Agreement.

 

 

My hubby then sent a letter back saying,literally, I'll show you mine if you show me yours.

 

Next thing was a letter confirming the account had been put on hold.

Hubby stopped paying and has not heard another thing from anybody since.

In fact his Credit Reference has not even been updated for years and is now very close to being statute barred.

 

So if I was you I'd ignore them until you get anything else worthwhile from them.

 

In the meantime you will get loads of help here should you need it.

no doubt you are on the dca merry go round! you have been SUSPENDED until the next **** dca send you a pay us now or else threatogram. only a judge has any legal powers. however the dca seem to think they are indeed the judge!

We thank you for your letter dated xx/xx/xx content of which has been noted

as stated in previous correspondence

“we do not accept that we are the original creditor,

the account has not become unenforceable by law.

We can confirm that all collection activity on the account will continue

but will remain on hold pending the provision of the requested document

where do I go from here any help would be gratefully appreciated

today i received a document from arrow global saying it was my credit agreement .

 

 

it just looks like an application for a credit card would it be possible for someone to take a look at the ocument and advise me and if so how do i upload it

hi this is the copy of the credit agreement sent by arrow global would appreciate anyone who may have any help in these maters taking a look tell me what they think as I’ve been led to believe its only an application for credit not an actual agreement any help would be greatly appreciated

OK it say application form on the front, but it does contain the relevant T&C's on the reverse

 

couple of things though

 

Did you blank out the year?

 

where did you sign it, ie in your home in a shop etc? cause they did not obtain any ID to say you was you

 

did they send you details of how to cancel, which is what it says on the bottom of page 1
