Hi - new to this so was wondering if anyone could help me?

 

I took out a quickquid loan back last year, unfortunately due to circumstances was unable to pay, so they referred to Mackenzie Hall who were really horrible to deal with and spoke to me like I was 2! I requested the CCA off them which they didn't provide and thus didn't hear anything from them, but now they have referred it to JB Debt Reocvery who are just as bad! :sad:I requested the CCA from them and they provided me with the following (I have attached this) - could someone tell me if this is actually enforceable and how to deal with these abnoxious crooks? (They also say I signed the agreement at 6:24AM - no way would I be up at this time!)

Hi,

I have unapproved the attachment for now as you have left the verification code on it (just below your digital signature) This could identify you.

 

Irrespective of whether the agreement is good or bad, it was taken out after April 2007 so if they went to court they wouldn't even have to provide the agreement although I doubt they will go that far.

 

With any debt collector, they cannot force you to pay more than you can afford. If you can't pay them what they want, send what you can. At least you are showing your willingness to settle the debt.

Ok Silverfox has sorted the attachment issue now.

 

Probably best to follow silverfoxes advice on this one.

As this refers to a payday loan it should be in that forum....

 

Report Mackenzie Hall to Alan Stewart at East Ayrshire Trading Standards, if it has already been to one DCA it shouldn't be passed to a second.

 

You should accept that this loan is enforceable but only at the amount of the original loan plus one months interest, most judges would accept this in court should it go there, you can mount a strong defence to have all the additional charges and fees dismissed.

I have attached the document again - how would i work out the original loan plus one months interest - I have no objection to paying (I took this out and the responsibility lies on me, however they are damn right rude and offensive to speak to!)

 

Anyone have any letters I could send to them - I can't afford much is £7 per month ok do you think - I have £324 outstanding

If that is all you can afford then so be it, a court would possibly offer much less, especially if you mount a solid defence (the particulars on these loans are very dubious to say the least).

 

If they don't accept it then you just have to wait for it to be passed around.

 

Why not ask your local CAB to get involved, they may be able to help.

 

Remember, do not speak to them on the phone, if they phone tell them all calls are recorded, and email them each time they call with confirmation that the call is recorded and you want a copy of their records.

It says in your document £200 borrowed, £250 to pay so you OWE £250, not £324. That would be the amount to defend should any court claim come your way, £250, NOT £324.

 

How many times has this been rolled over.

It was rolled over once - but still I don't know where the £324 would come from as even if it is rolled over its goes in multiples of £25 doesn't it?
