After several months of QQ refusing my offer to repay (unless it were in 3 installments), they have finally passed me over to Mackenzie Hall. They have also just refused my offer to repay over 12 months which would actually clear the debt.. (this is all i can afford as i am paying of other pdls as well) Below is the email they just sent.....any advice please guys??

Thank you for replying regarding your Quick Quid account.

Unfortunately your proposed payment plan of £xx per month has been declined as this will not halt the legal action pending on your account.

As you are aware your Quick Quid account is a Pay Day Advance repayable within 30 days of borrowing and, having signed a legally binding contract stating the funds would be repaid within this timescale, you are now in breach of this contract. Your proposed payments of £xx per month would take 12 months to clear most of the balance which is unacceptable.

We can, however, offer a 3 month Payment Plan to clear the account in full - £xx per month. This is strictly the longest term available for repayment.

Any payments made to this account under £xx will not be refused but will be classed as token payments and will not prevent the legal action from going ahead. Please be aware legal action involves an application being made for a CCJ (County Court Judgement) to be applied to your credit file and if employed, an Attachment of Earnings can then be enforced with no negotiations for repayments. If unemployed, then a Warrant of Execution would be issued for Seizure of Assets amounting to the outstanding balance.

Please note, any Legal Costs & Interest will be added to the outstanding balance with yourself being liable for these costs.

We would much rather come to an amicable arrangement on this account but unfortunately have no option but to pass for Legal Action if the required Payment Plan is not met.

My QQ account has recently been passed to Mackenzie Hall for approx 650.

 

Received a couple of letters from them like the one above and offered them 50 per month.

 

Was refused a few times - I just kept emailing them telling them this is all I can afford and I will make payments via the website even if they do not accept the payment arrangement. They originally wanted repayments over 3 months - if I could afford that I would have arranged to pay QQ over this time.

 

Now they have bought the debt from QQ they can wait for the money over a time period that suits me !!

 

I had a number of other payday loans with Wonga, PTP and Payday Express that I am paying off monthly - my offer was finally accepted when I sent an email as below:

 

As you are aware payday loan lenders charge excessive interest rates due to the high level of risk with their borrowers.

 

In order to get off this roundabout of payday loans with multiple lenders I had to default on all these loans - these also included other lenders such as PTP, Payday Express and Wonga.

 

Having coming to agreements with all of these lenders with monthly repayments ranging from ?40-?50 >>> I cannot understand why yourselves are not willing to accept my repayment offer - and will only recognise any payment as a token offer.

 

Therefore, I may just as well make a token payment of ?1 a month and let a judge decide on a reasonable monthly repayment!

 

Good luck and keep emailing them with the same offer - they will accept eventually - keep everything in writing (via email)

Thanks Benjani....i feel the same as you...if i had been able to pay QQ in just 3 installments, the debt would not be with Mack Hall now!

no probs, it took 3 or 4 emails back and forth but worked eventually !!

 

other points i made where:-

- As a DCA surely you must understand I can only afford what is reasonable and I am not going to leave myself short as I do no intend to apply for credit elsewhere.

- threatened to add this debt to my debt management plan meaning a repayment approx 10 per month !! - I am aware of the action that can be taken to recover this unsecured debt and I am sure any court will recognise I have made a reasonable offer on this debt that you have declined - and any court action may result in reduced monthly payments of approx ?10.00 per month if this debt is added to my debt management plan.

Hi, my QQ account went to MH to.

I am on benefits and couldnt afford to pay what they wanted. I just said they had to accept my payment I could not pay anymore and if it went to court the court would see what I could afford, I also said that the court may put amount to be paid down.

 

It took a while but it is sorted now and payments being made. They do keep on though about upping payments but I just say I cant at present which is no ly I cant.

 

Do not set up any DD with them. I pay mainly via their website.

 

Also please note that if you telephone them to make a payment or use their website to make a payment they will charge you an extra £1, so make sure that it you pay this way you allocate an extra £1 to your payment.

Thanks for all your advice...

I received another email today offering me the chance to spread payments over 5 months....i wrote back that i could not afford that and again offered my "terms"...am still waiting to hear back.

It seems strange that you can only pay over the phone or via Mack Halls website...is this just their way of getting more money from us at £1 a time?

Does anyone know if they have a bank account to enable me to pay by standing order or over the counter? (if and when they come to an agreement that is)

Hi

On the Mackenzie Hall website there is an option to download a standing order form - on that is there bank account details - so I supposed you could take these and setup an online standing order quoting the M reference as your payment reference.

I currently pay via debit card each month but will probably setup a standing order when I get chance!

Just a quick question ... I wondered how long it took QQ to pass on to a DCA?

Just like you shanti I am getting the ever so boring emails stating the same thing and they wont accept a plan over 3 months - suprise suprise..

Took about 4 months for mine to go to a DCA - was never going to agree for repayments over 3 months so just ignored all the emails and voicemail messages from them for ages !

They only added 1 default charge of £12 and no further interest so happy days !

If you dont want them hassling you all the time change the contact numbers and employment details before you default !

They only had my mobile as a valid number and was always some American from QQ requesting me to call them.

Never called them once!

Now dealing with Mackenzie Hall and repaying £50 per month.

Thanks benjani.. Its nearly a month since I defaulted with them and I've had one call with one voicemail and the odd boring email.

 

I'll keep responding to their emails with the same plan for the next couple of months.. Doubt they will accept but least it shows I tried. Good advice above by the way might use one or two points when I eventually get passed on to mack hall.

Hiya Tink....

Like Benjani, it was about 4 months before QQ passed me over to M Hall. I gave up replying to QQ's regular emails....but kept copies of all the ones previous that had my offers of payment.

I had several phone calls too, but either ignored or hung up once i realised it was them!!

You just need to hang on in there....your turn will come!!

I am still waiting for Mackenzie Hall to respond to my last email....will keep you posted on developements.

Thanks Shanti.. QQ have offered me a plan of £56 for the next 2 months which is £112 which is one months interest and the £12 default fee - which would make it all pointless so im not agreeing to that.

No, only the default fee is questionable, if this went to court the minimum you would be asked to pay would be one months interest on top of the original loan.

 

For the sake of £12 is it really worth giving yourself a lot more grief. Whilst I know £12 may represent one weeks food it is a small amount compared to what they have tried to charge people in the past.

 

The offer seems extremely reasonable to me.

Sorry must have worded that wrong.. I currently owe then £500 and I have been paying £100 interest for the past 5 months and last month decided to take the plunge and default. Now what they are saying is they want me to pay £112 which is only rolling it over ? they have split the rollover up into a plan of £56 for the next 2 months which is pointless because I would still owe them £600 once I have paid the £112. I obviously dont mind paying the £12 seen as though thats the only charge they have added.

 

hope that makes a little more sense..

I now see where you are coming from, play them at their game and email them confirming that the £112 is all you need to pay to clear this loan and then see what they say... if they get funny state that you have rolled it over for 5 months and that you cannot afford to keep rolling it over, that your situation has now deteriorated even further and you are trying to get this repaid in the best possible way for both parties.

I have not agreed to the plan either! They are trying to get even more interest out of me.. I shall reply again but its like talking to a brick wall!

Hi I am with Mackenzie Hall for Quickquid & Payday UK

 

I got into trouble early this year with two pay day loan companies I had to stop work and had very little income so couldn't pay them.

I understand that I have to repay what I owe and have kept them up-to-date with everything well in September they passed the accounts to a debt collection agency called "Mackenzie Hall" I made an arrangement with them but due to Natwest defaulting my bank account all my money in that account was lost so the agreement was cancelled they have since sent me many letters and phoned loads of times (which I dont answer) and now sent a letter from Meritforce saying they will take me to court I have emailed them 3 times before this to arrange a token payment until feb when my finances get better but not received a reply from them once what can I do?

I don't really want to get a CCJ because work will find out but what happens next does anybody know? Please help

the chances of them going to court is slim. stop ignoring them firstly, speak to them arrange a new plan explain the problems you've had and then have everything confirmed in email. dont give them your debit card details or sort code or account number, pay them by standing order. problem solved.

All i have had from M Hall are a couple of letters threatening court action and a series of email replies saying they cannot accept my offer. I am not sure what to do next. Do you really think that phoning and speaking to someone will help? They've been adamant up to now that they cannot accept my offer.

Hi All Yesterday I got an email from Mackenzie Hall saying they will accept token payments until my finances improve (Feb) from £879 down £35 per month until Feb then make payments of £150 but want all my creditors names and amounts outstanding should I give them this information? I have told them the amount of debt I have and the end date of some of it.

Hi Shanti

 

I wouldn't phone unless you are happy to stand your ground and take their insults. If you are strong it can be good fun. The beauty of doing it in writing is that you have evidence to put in front of a judge if they ever tried it (doubt it though). They will eventually have to reach agreement with you. You are being more than reasonable.

hi robjam, i should have been more specific, phone, come to an arrangement and then have it confirmed in writing. stand your ground on the phone and hang up if they are rude and you can tell them that, if you continue being rude to me i will hang up the phone or would ask to speak to someone else more senior than yourself.
