Dear Sir/Madam,

CARD/ACCOUNT NUMBER: xxxxxxxxx

I now understand that the regime of fees which you have been applying to my account in relation to late fees and over limit charges, are unlawful at Common Law, Statute and recent Consumer regulations.

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary.

I calculate that you have taken £XXXXX plus £XXX which you have charged me in interestlink3.gif for the sums which you have taken. Total £XXXXX

Additionally, you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you, or was the result of impecuniosity caused directly by the taking by you of penalty charges which you had applied unlawfully to my account.

In addition to full payment of the sum mentioned above, I require that you remove the default entry from the register. Please note that mere correction or amendmentlink3.gif to the entry will not be acceptable.

I require repayment in full of this money and removal of the default notice. If you do not comply fully within 14 days, I shall begin a claim against you for the full amount plus interest, plus my costs, without further notice.

Yours faithfully,

Hi

A few questions before i proceed. Thanks DX for the temp.

I am sending this claim to the DCA,is this correct?

If so do i remove from the letter wording in regards to the default notice & default entry as regards to my CRA file as this would have already been done by Goldfish????

Thanks

I have drafted letter which includes CRA stuff.

How does this read????

Also i have put the end date on the CIS spread as the 12/06/2012.This was the date which gold sold the debt.

Is this correct.

Be good if someone could view and advise!!!!

Thanks R

spreadsheet runs until the date its settled.

PENALTY charges reclaims ALWAYS go to the Original Creditor.

i'll read it later.

I will have to amend back to your original copy as i wrote it as though going to DCA.

This seems to be conflicting advice as per my MBNA post or is that because there are court papers involved with that??

no reclaim ever goes to a dca court claim or otherwise.

you might be 'using' the claim in a court fight against a DCa

but the sums always come from the original creditor.

Hi Francoe,

If you haven't amended it yet, this sentence is now left off the new template as it is considered to be unnecessary :-

I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary.

If it's already done, no matter but leave it off the next one which will be the LBA.

Ok Letter & CIS

Suppose letter is standard.

So i am right in saying that this claim is going to Barclaycard Goldfish, the original creditor?

The claim will make a significant difference to the balance that arrow claim i owe.

Hi Francoe,

The letter and spready look good.

As quoted on letter its 14 days to respond. Can i clarify its 14 days flat from the date of my letter or is there any allowance for posting.

For example my letter was dates & sent on the 29/10/2013.

So on the 13/11/2013 i will post LBA.

Taking into account they do not respond or disagree.

Hi Francoe,

Send the LBA 14 days after you sent the Prelim unless they have by then agreed to refund what you asked for.
