ok here is the problem.


Customer had some work done by a company Kai Performance Ltd which is no longer in existence and went into liquidation in February.


His van was apparently not right and he took it to another garage even though Kai Performance Ltd had asked for it back to try to resolve the issues.


Customer is now taking "Mr Warren Kai Performance" to court for the monies he spent with the other garage and his initial spend with Kai Performance Ltd.


Now i thought that if the company was LTD then it protects the directors with limited liability and also the customer should be taking Kai Performance Ltd to court and not trying to implicate one of its directors even though the directors name is not Mr Warren.


So all the paperwork is addressed to an individual "Mr Warren Kai Performance"


Where do I stand please.


Am i right in thinking that they cant take a director of a LTD company to court unless a criminal offence and also taking somebody to court that doesnt exist ????


your help would be really really welcome.

Wazza1970 welcome to The Consumer Action Group community.


You haven't received any replies to your problem yet so you might be better off posting your story again directly in the sub-forum which deals with your kind of situation. You will get lots of support there.


Also, spend some time looking round the forum. Once you understand the layout, you will be able to get best use from this Consumer Community. It is a big forumm and may take some time. But it will be worth doing.
