You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Oredered phone/internet from talktalk, recieved my router through the post and told that they would turn up today between 8am and 1300.

Engineer phoned 2 days ago to confirm he was comming(which I thought was very good).

Guess what?

Not turned up, not even a phone call !!

Called talktalk, they said that because they contract out to BT they can do nothing about it and I will have to wait until friday to book a new appointment.

Took a day off work today.

 

Soooo bloody angry!!

All I ask is to be treated fairly and lawfully.

TalkTalk are Dependant on BT Openreach for installing lines and maintenance.

 

Now I'll assume you were having a line installed. Can I ask have you got a BT box in your home? If so the engineer may not have needed to access your house, and has connected all the wires up in the green box at the end of your road and in the exchange. If you have all the equipment, try plugging it in!

If in doubt, contact a qualified insured legal professional (or my wife... she knows EVERYTHING)

Was with TT at my old house, no problems whatsoever, and the moved about 2 miles away 8 months ago and the problems started.

 

From day one of the move to new house the internet connection has been a nightmare, not connected, constantly dropping the connection and speeds ranging from 00.5 meg to 5 meg.

 

Approx 10 visits from engineers, 3 routers and 3 filters later the problem still exists.

God knows how many times ive called TT, at least about 20 I reckon.

A few of the engineers have said the fault is between the exchange and the house, and yet TT have done nothing.

 

I'm useing my 3 dongle to write this, TT is down yet again!!!! The dongle is brilliant, never drops and I get 6-7 meg consistent.

 

Ive had enough of TT and am going to another provider, ive still got time to run on my contract with TT, they won't be getting a penny.

 

TT customer service? = non existent!!!!

All I ask is to be treated fairly and lawfully.

Came in from work tonight, internet connected but really slow. Went on TT website to check my speed= 0.31 meg!!!

Guess what, TT website said that it was pretty good!!!! FFS TT!!!!!

talk talk are terrible, i was on nildram they were brilliant, until they got bought out by talk talk. agetting a mac code took me 3 months!!! been with sky for nearly two years, not a single problem.

Support this great site where free invaluable advice is provided.

I've saved £1000's because of this site...so could you.

i'm thinking of leaving talk talk but i dont know who else to go to. talk talk;s internet is constantly going off and my bill seems to only be increasing higher and higher. lol anybody know of any good internet and phone packages? i sued to think talk talk were it, but lately they seem to be getting worser and worser.
