Hi,

 

Wondering if someone could help, I defaulted on a payday loan I dont remember recieving a default notice but its there on my credit file. I have asked the company when they sent it to me and advised via email. I checked my emails and I dont ever seemed to have recieved it. I have asked them for a copy of this and they said they will get back to me (over a month ago) The default is also recorded as a mail order catalogue as oppsed to a loan....I asked why this was and they admitted it was an error and will rectify it (still not been done) can i request for removal of this as someone has clearly made an error inputting the information so i this then invalid????

Contact the credit reference agencies and tell them there is an error in your credit file

If you have it in writing all the better.

 

They will then contact the creditor if they don’t get a reply from the creditor they will remove it, if the creditor then says it is correct you will have to start making official complaints to the likes of the information commissioner’s office.

But you have to give them the opportunity to correct any genuine mistake first.

Thanks for your responce. Could you explain the difference between a default notice and a default on my credit file then??? Sorry all a bit new to this. I started to experience finacial difficulties about 18 mths ago and missed payments on a number of accounts, i then started to take out payday loans to help me out which was stupid I know. I am now financially stable and want to get back on track. I currently have 3 acc on my credit file (vanquis / cap one and a payday loan)that are marked as payment defaulted. I have since paid one off and thats showing as paid (vanquis) I still owe cap one but am trying to arrange payment with them however since they marked my payments as defaulted they have since given me unlawful charges back meaning my balance is now £300 less than the defaulted amount and then i have this payday loan as explained above. Will these all effect my credit worthyness for the next 6 yrs???? More seriously than these I have recently been issued 2 CCJs. 1 was 2 months ago which I should have dealt with at the time but i was niave and stupid....is there any way I can fight to have this removed???? My 2nd one was issued 3 weeks ago, is it true if i settle this payment this week (within 1 mth of being issued) I can have that removed too????

A Default Notice is where a company formally advises you that you have missed a payment (or 2 or 3 etc). These must be sent in the approved format in that they have to give you a date to remedy the default (missed payments). This date must be at least 14 days from when it can be assumed that you would receive the Default Notice.

 

Once the default remedy date is passed, this is usually when the account is closed and passed on to Debt Collection Agencies or Departments.

 

A Default Notice that is placed on your credit file is normally, but not always registered on the date that you failed to remedy the default, although this can be at a later date, but usually accepted that this must be within 6 months of the Default.

 

Hope that helps.

 

Defaults show on your Credit File for 6 years from last acknowledgement/payment. So if you are making payments, then this is resetting the Statute Barred clock as far as the chasing of a debt. Usually the debt will 'fall off' your credit file 6 years to the day from the date of the Default.

 

Making payments is sometimes shown on your file, but creditors never take this into consideration these days.

if you have ccj and defaults then cleaning up your credit file is not imposable but it is very close to imposable it will take a long time and a lot of research
