      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

I am using AXIS BANK Travel Corporate card.

Today(8 oct 2010),I made a transaction for 800 pounds at LLOYDS TSB BANK ATM.Atm didnt give me the money,but showed transaction complete.

I again withdrew 20 pounds which was success.To my surprise my account was deducted by 820 pounds,where I didnt receive my 800 pounds.

I raised Cash dispense dispute against my AXIS BANK.I got irresponsible answer form LLOYDS TSB People.I am not sure whetherI get my money back or

not.I am really worried about this,as 800 pounds is a huge amount.Is there anyway to proceed legally to get my amount back.

 

Please give me your valuable suggestions.

Welcome to the site.

What time did you make the first transaction for the £800 ? Did the Atm give a receipt ?

What time did you make the £20 withdrawel and did it give receipt ?

How did you report the shortfall ?

ATMs have cameras with recording.

They will also know if you were short changed by doing a count.

You need to go in branch at the location of the ATM.

Dont deal by telephone.

Before going down any legal route,you will need to show evidence in writing that the bank have investigated and you remain disatisfied.

£800 is lot of money as you say.

If they cant give you an answer in branch immediate then get a sig for the complaints letter you should also be taking at the same time-and keep a copy.

Hi Team,

Yesterday afternoon at 2.45 ,i have withdrawn 800 pounds,after receiving the card waited for 2-3 minutes ,it didnt came up with money.The next moment I have withdrawn 20 pounds from the same ATM .Two consecutive transactions made one for 800 and one for 20 pounds.

After collecting 20 pounds ,immediately I went to Lloyds Bank and reported the same and they asked me to deal with Axis bank.I am completely hopeless now.

 

For 800 pounds , i chose option Cash only(without receipt).I have only my internet banking statement as proof.

you need to go intonthe branch/bank and fill out a visa dispute

as stated, on all transactions a copy receipt on all transaction is recordedf on a till roll inside the atm

 

to retify my shortage took about two weeks but if you bank with barclys and the machine is barclays for instance, it can be done straight away

 

its third party atm and cards tht take the time

Is this ATM in the UK?

 

I have had this happen in the US where the ATM's seem to go through a different sequence, effectively I didnt receive my $400 but did receive the $200 I later tried to withdraw, basically the ATM checked for funds said it was paying them out, but then couldnt either due to a fault or lack of funds, the scary part is it debited the money on the tuesday at witchdrawal time but didnt re-credit them 24 hours later..

This is a matter between your foreign bank and the ATM operator. It will require an audit on the transactions that day for that machine, and a reconciliation of the amounts dispensed. There is really nothing you can do at the branch, as they won't simply hand over the £800. I have to say I doubt any machine will dispense this amount on a foreign bank card. as internal limits are placed on the transactions, sometimes preventing lower amounts, usually highter (with a £200-250 limit the norm). When you enter an amount outwith the normal one allowable for that machine, it usually shows a message stating 'your bank has declined this transaction' (when it hasn't).

I am just letting you know that as you haven't had any replies to your post yet, it might be better if you post your message again in an appropriate sub-forum. You will get lots of help there.

 

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.

 

 

Once you start to find your way, you will soon realise that it is fairly easy to get round and to get the help you need.
