Your thoughts would be appreciated.   [email protected] [email protected]   Re: MET Parking PNC at your Starbucks Southgate site   Dear Ms Rayner, / Dear Heather Christie,   I have received a Notice to Keeper regarding a Parking Charge Notice of £100 for the driver parking in the Southgate Park Car Park, otherwise infamously known as the Stanstead Starbucks/McDonalds car park(s).   Issued by: MET Parking Services Ltd Parking Charge Notice Number: XXXXXXXXX Vehicle Registration Number: XXXX XXX Date of Contravention: XX.XX.XXXX Time: XX:XX - XX:XX   After a little research it apears that the driver is not alone in being caught in what is commonly described as a scam, and has featured in the national press and on the mainstream television.   It is a shame that the reputation of Starbucks is being tarnished by this, with your customers leaving the lowest possible reviews on Trustpilot and Trip Advisor at this location, and to be associated with what on the face of it appears to be a doubious and predatory car park management company.   In this instance, during the early hours of the morning the driver required a coffee and parked up outside Starbucks with the intention of purchasing one from yourselves. Unfortunately, you were closed so the driver walked to McDonalds next door and ordered a coffee, and for this I have received the Notice to Keeper.   It is claimed that the car park is two separate car parks (Starbucks/McDonalds). However, there is no barrier or road markings to identity a boundary, and the signage in the car park(s) and outside your property is ambiguous, as such the terms would most likely be deemed unfair and unenforcable under the Consumer Rights Act 2015.   I understand that Starbucks-Euro Garages neither operate or benefit from the charges imposed by MET Parking. However, MET Parking is your client.   Additionally, I understand that the charge amount of £100 had previously been upheld in court due to a ‘legitimate interest in making sure that a car park was run as efficiently as possible to benefit other drivers as well as the local stores, keeping cars from overstaying’.   However, this is not applicable when the shop or store is closed (as was the case here), as there is no legitimate interest. Therefore, the amount demanded is a penalty and is punitive, again contravening the Consumer Rights Act 2015.   As the driver’s intention of the visit was genuine, I would be grateful if you could please instruct your client to cancel this Notice to Keeper/Parking Charge Notice.   Kind regards
    • I received the promised call back from the Saga man today who informed me that the undertakers have decreed it IS a modification and they will need to recalculate a quote individually for me. However it all sounds very arbitrary. The more I think about it, and with help from forum replies, the more I am sure that it is not a modification. If for example the original seatback had become damaged by a spillage or a tear, I would be entitled to replace it with the nearest available part. The problem is when it comes to a payout after an accident, there is no telling what an individual insurer will decide when he notices the change. I am still undecided which of the two best routes to go with, either don't mention the replacement at all, or fill in the quote form without mentioning, and when it comes to buying the insurance over the phone, mention it at the time.

    • Hello,  I received the standard letter.  I don't understand No. 3: If this is in relation to a ticket irregularity, then if you were unable to produce a pass because you did not have it with you or if your pass was withdrawn because you were unable to produce a valid photocard to accompany it, please enclose a photocopy of the pass/photocard with your reply. Question: do i enclose my photocard? my partner's freedom pass was confiscated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all!

 

This seemed minor at first but it's started to get annoying rather fast :shock: The other afternoon hubby received a call on his mobile which he didn't get to in time to answer, however it was an 0844 (or similar) number. He phoned it back and it turned out to be Westcot, chasing someone else, they'd obviously got the wrong number, which he told them and politely asked them to remove his phone number from their system which they said they would (Duh in hindsight lol!) After getting off the phone he also discovered a computer generated message on his voicemail requesting he phoned them.

 

Then last night, about ten to nine, same thing happens again. Hubby phones them back, again they tell him the name of the fella they are chasing - that's ok, they're a DCA, data protection means nothing to them! - he tells them they have the wrong number again and asks them to amend their details, very politely I thought :wink: Knew it wouldn't work though and surprise, surprise, another phone call this afternoon which he didn't answer, there'll probably be a voicemail message asking him to call back.

 

I figure that it's probably time to write to them and wondered if anybody here had any suggestions on how to concoct a suitably stong worded letter that they won't just ignore? (I'm not very good at that sort of thing) as all it is, is they simply have the wrong number but seem unable to update their system! I realise it's a pretty minor problem but after three days it's getting darned annoying and I'm not sure if it's going to stop otherwise!

 

Any help gratefully appreciated :|

Wetcloths are too stupid to be able to read anything you send - they never did with me :( You will get better results by complaining to Trading Standards and the OFT.

 

Darn, was hoping it wouldn't have to come to that but I hear what you're saying :( I'm also wondering if we'd be able to report them as nuisance calls to hubby's mobile provider? Might look into that too....

next time they phone try and record the converation and if they give details away about the party they are chasing then you have some ammunition to make them stop, failing that say in writing and put the phone down, they soon get tired of it

Thank you :) All they have given is the name of the fella they are trying to get hold of (poor sod!) Hubby phoned them earlier in an attempt to talk to a supervisor - haha! - and told them in no uncertain terms that he thinks their company sounds incredibly non-legit lol, which the lady on the other end strongly denied... However, she did shed some light on why he is receiving these calls - apparently, mobile phone numbers are regularly recycled and it would seem that is probably the cause of the problem as he's only had this phone a couple of months (new contract). Which makes me think this isn't the end of the problem somehow. After some googling around, I have found a blog/forum dedicated to a single phone number (Westcot) which contains EIGHT pages of singular complaints from people having the same problem! Why am I not surprised?!! Once again, I am disgusted by the behaviour of these DCA's who shouldn't even be flipping burgers (no offence to burger flippers!)

 

On a lighter note, I took a look at their website and haven't laughed so much in a long time!! "Integrity", "Ethical" and "Professional" are NOT words they should be bandying about willy-nilly LOL :lol:

Further to our telephone conversations on ........... I am writing to demand that you remove my telephone number from your database.

You are well aware that I am not the person that you are looking for as you were kind enough to give me his name! I think that I may have forgotten to mention the fact that I record all telephone calls to and from 0844 numbers, and have the recording of you breaking the DPA.

If you would like me to do your job for you, please supply me with the address of the person you are trying to contact and I will contact him myself and tell him that you are giving out his details to complete strangers and I will ask Mr ............ to contact you with details of the relevent bodies that he has complained to.

Please find enclosed a bill for £xxxxx this is to cover the cost of my telephone calls to yourselves.

Huggys boss, thank you for that letter, it is absolutely perfect and we'll be sending it off to them this evening, they phoned again this morning at 11am. It would seem they are incapable of the simple task of removing an incorrect number from their records, bet they don't have that problem adding a number, huh?!

I must agree that mobile phone companies do recycle numbers, I have had my contract phone with Vodafone for about 18 months now, and to begin with I was getting calls and texts for a guy called Josh on a regular basis.

Thanks Lee, it's ok now. Just the occasional text. I did manage to get one of the guys friends to contact him and he told everybody in his phone book to stop using his old number. If I start getting DCA calls for him though, I will be giving you a shout.

 

Getting back to Brandibroke, if Wescot are not calling about a Voda debt, would it be possible for Voda to contact Wescot on Brandi's behalf and confirm that it is a recycled number?

Thanks for coming back to me, I'm pleased to hear things has settled down for you.

 

In regards to BrandiBroke's case, in the event that Wescot are using a recycled number or the number they're using has been inputted into their systems in error I'm happy to help in anyway I can.

 

Naturally, I'll need some information relating to the debtor they're trying to contact to assist Wescot with tracking it down and from what BrandiBroke has posted they have provided the person's name which gives us a starting point.

I've had my landline for 7 years and still get calls for the people who had it before me even though I'm registered with the TPS.

 

Every six months or so I get calls on my mobile from a guy askng for Sam...I've had the number for over 10 YEARS!!!

Good heavens Babybear, that's madness! I must confess that until this I had never heard of number recycling, never had reason to I guess. Makes me wonder whether anyone out there is using any of my old numbers lol?

 

Now then Lee, I followed your instructions and we have sent the email to Vodafone, except that I forgot to put that code in the subject box and didn't include a link to this thread - is that bad? Kids coming in from school distracted me :/

Although your email won't reach us directly without the WRT135 code in the subject line you should've received an automated reply either in your inbox or maybe in your spam/junk folders which will have a reference number. If you could update the thread with this I'll be able to track it down.
