My wife received a letter out of the blue two months ago from the Department Of Work & Pensions saying she owed £293.

The letter was address to her at our address but in her maiden name.

We have lived at this address for 12 years and been married for 9 years and we have no idea where this debt arises from except that my wife changed jobs in 2001 and her previous job she received tax credits so could possibly be due to an overpayment from then?

 

She ignored the first letter because a) we couldnt understand what the debt was attributed to b) thought it could be a [problem]

 

However, last week had a letter from a Dept Collection Agency seeking payment, again in her maiden name.

 

Do we have to pay it? Even now we're not sure what its even for..

No thats HMCR. It could be an overpayment of benefits from years ago, crisis loan etc. Ask them for proof of the debt.

Dear

 

 

I Do Not Acknowledge Any Debt to Your Company

 

I am writing in reference to your letter dated xx/xx/xxxx

 

I would ask that no further contact be made concerning this matter unless you can provide evidence as to my liability for the alleged debt in question.

 

If you are unable to provide evidence as to my liability I await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

If the debt exists and it's more than six years old it will be Statute Barred and no enforcement can be taken i.e applying for a CCJ. However.... the DWP have a partial exemption in that they can still recoup these monies from any future benefits or pension your wife may get.
