Mansfield PCN

Hi,

I have just joined the Forum, as for only the second time in my diving life have I had a Parking Ticket. (The first was in Spain....)

Anyway story is went for a short visit to Mansfield and parked in the same place I have parked many times before, on White Hill Drive. I was going to post a google Street View Link but I need 20 posts here first

Spaces here are a mixture of Residents Only and General, when I have parked there I have always been careful to only park in the general spaces.

So as you can imagine I was more than a little surprised to find a PCN on my window on my return.

As this is the first time I have had to deal with a PCN can someone please advise me what to do?

Send in informal reps with the photos and explain that it is a free bay not a shared use bay and that the contravention did not occur.

That bay is clearly signed as "at any time" with the only restriction being the time limit. You have not committed that contravention because the signage does not impose that restriction.

I have just been told that there is a sign at the entrance to this street saying something like Permit Holders Only Beyond this Point, didn't see the sign myself, but in any case the sign on the bay would override that sign?

 

Looking in the Traffic Signs Manual Chap 3 dft.gov.uk/pgr/roads/tss/tsmanual/tsmchapter3.pdf there is a sign Fig 7-3 Page58. It says this sign is Not Prescribed in the Regulations and requires special authorization.

 

Assuming there is a sign like that does that make any difference to my appeal? The sign on the bay must trump that??

I agree. The sign next to the bay prescribes the conditions for that bay. The sign at the street entrance gives a general underlying restriction, which need not apply in every bay. They may not have meant to have this bay as free parking, but as I see it, that's what it is.

 

Definitely appeal and let us know what happens.

This sign is an NP434, which needs the authorisation of the D for T.

We have seen these signs before on this site. you need a copy of the aithorisation as each of these areas are different from each other.

The Dept for Transport is the quickest way to get this file.

Thanks for this, not sure if the initial sign was there, but in any case the bay I parked in did not have a Permit Holder sign....

 

I have now put in an informal rep as suggested above saying I only parked there because the signs said I could - we will see what they say....

I would still make a Freedom of Information Act request to the Dept for Transport, as then you will have in writing what the Council can do and above all can not do.

This will allow the council to do away with parking bays along the length of the effected road.

It will not follow that your parking place will have to have the same stipulations from the D for T as another such location where I live.

Each location has different permissions.

Hi,

Just to let you know that I have had a letter this morning from Notts Parking Partnership, canceling the ticket!

 

It says I should have seen the (very small) notice on the road in saying "Residents only parking beyond this point" but admits that work to change the previous scheme's signs and road markings had not bee completed when the ticket was issued (I don't think it had been started...)

 

Anyway happy it is canceled, but will have to find somewhere else to park IF I ever decide to visit Mansfield again! - Any suggestions where?

Codswallop. If there are restrictions they have to sign them at the side of the road, AIUI. If they were sure their signage complied they would most likely have not cancelled the ticket and let you take it to PATAS. They're cancelling it to save their face without admitting their signage doesn't comply :o

I know - but I didn't really expect an apology - they like to try to make you feel guilty.....

 

Don't really care - I see it as a win!
