Hi guys,


I just received the 2nd letter off HSBC (the letter after I sent in requesting the refund with my charges list, the first I received was a list of the charges).


the letter reads:


We are writing further to your complaint relating to bank charges.


As you will be aware, issues relating to the level, fairness or lawfulness of these charges have been the subject of legal proceedings between us (with several other banks) and the office of Fair trading which started on 27th July 2007.


These legal proceedings have now ended, with the Court confirming that the bank charges are not capable of amounting to penalties at common law and that the level of them cannot be assesed for fairness under the Unfair terms in consumer contract regulations.


In summary, we believe that the disputed charges were properly charged and the outcome of legal proceedings confirms our position. We are therefore not upholding your complaint and we will not refunding the bank charges.


Turning to your comments regarding default notices entered against your credit record to be removed, I respectfully request that you foward a copy of the relevant Credit Agency Report to enable us to investigate the matter further.


If you believe that we have failed to address all the issues raised in your complaint, you may escalate your by contracting us setting out the details so that we can consider this further. All correspondence should be addressed to




we should point out, however, that we do not believe there is any legal basis on which the amount of the charges can be challenged. If we do not hear from you within 8 weeks of the date of this letter we will consider your complaint closed.


Ultimatelyh, you have the right to refer your complaint to the Financial Ombudsman Service. Before you decide whether or not to take your complaint to the Ombudsman Service, we strongly recommend that you consider the information about this subject on the financial ombudsman service's website at:
