Help need from scottish members

Hi,

 

I am trying to help us to try and collate any court docs or info that we and others can refer to for help.

 

These would be for any type of actions.

 

If you can send me via PM any examples of any Incidental Applications, requests for info and defenses or anything else you have had to send/take to court.

 

I will personally ensure that NO personal Info will be left on these

 

If the files are to big or you having problems sending them via PM, then leave me a messgae or PM and we can work around it.

IA's are pretty boring Ida - they just are a short-stop (usually by the defender) to take the wind out of the sails of the Pursuer. The best I've seen was just 2 sentences long. "The Defenders contend the Pursuers case it without merit. The crave the Court to adjudge the competence of the action and have it sumarily dismissed."

 

At a stroke, this means it becomes THEIR party, and you don;t get a chance to discuss the merits of your dispute. That will have to be held another day, assuming the Sheriff doesn;t agree with them...

Yes they can be Buzby but just trying to get some basis so we can have some templates for folks that need them,

 

anything really that is needed in the proceess of any case

Because IA's and their reasons can be so wide-ranging, especially as it can be introduced to bring in absolutely anything the applicant requires, a template for such a thing would be so wide-rangng as to be effectively useless, as it would need to address whatever is required as part of the dispute (or manipulation of same)!
