    • Good Evening, I've got a fairly simple question but I'll provide some context incase needed. I've pursued a company that has operations in england despite them having no official office anywhere. I've managed to find a site they operate from and the papers there have been defended so I know they operate there. They've filed a defence which is honestly the worst defence ever, and despite being required to provide their witness evidence, they have not and have completely ignored the courts and my request for copies of it. I'm therefore considering applying to strike out their defence on the grounds the defence was rubbish and that they haven't provided any evidence for the trial. However, it has a trial date set for end of june, and a civil application wouldn't get heard until a week before then, so hardly worth it. However, my local court is very good at dealing with paper applications (i.e ones that don't need hearings, and frankly I think they are literally like 1-2 days from when you submit it to when a Judge sees it. I'm wondering if I can apply to strikeout a defence without a hearing OR whether a hearing is required for a strikeout application.   Thanks
    • I have just opened another bank acc with lloyds (i have a few already) After doing some research they may have some relation to tsb or be apart of the same group will this cause me issue if my salary is paid into my lloyds account? Also, if the debts do go into default and nothing is paid then after 6 years it all goes away? As the DCAs cannot do anything? I do want to start paying in like 3/4 months or do you advise I leave it if it goes into default? again sorry for all the questions, i am just processing everything

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I wrote to BG on 24th July after realising there were 2 defaults on my Experian CRF. I sent them a CCA request and the £1. I have today received the £1 back and a letter from them asking me for a copy of my file because they are having difficulty finding the default that I mentioneded, although they searched my file as an enquiry on 11th Aug. They are obviously in default now and the offence occurs on 10th Sept, so shall I wait until then, or send copy of this to CRA and get the default removed? Any info on what to do next would be great

I have sent the long letter and statutory notice and received abck from BG a letter saying they would not remove the defaults, and they have no record of one. I am sending this back - is the right letter to do?

Letter Before Action

 

Dear Mr White,

I refer to your letter dated 5 October 2006 regarding defaults that British Gas has registered with Credit Reference Agency Experian. I enclose a screen shot of my credit file as of today’s date showing the default registered by your company that you admit you have no record of.

I also refer to the Statutory Notice that I sent you on 2 October requesting that you stop processing my data. To my knowledge you have not now or ever had my express consent to share my data. Your letter states that when opening my gas account I would have been sent a ‘ Welcome to British Gas’ pack, I have no recollection of receiving this, and as such never agreed to your terms and conditions.

With regards to the £20 overpayment that you refer to, a cheque to my home address made out to myself will be acceptable.

Paragraph 3 of your letter entitled legalities – quotes the following from the Information Commissioners Office regards the practice of registering defaults for a period of 6 years as one that serves legitimate business practice providing the registration was justified in the first place. By your own admission you have no records of registering a default on my credit files for the amount of £78, and am at a loss to understand how you feel the continued processing of my data in this manner is justified.

I therefore request that you remove these defaults within 7 days from receipt of this letter or I shall be left with no alternative but to pursue their removal through court action.

Did they just mark the entries as satisfied, or remove them completey?

They are going to remove them completly - one is satisfied anyhow.

 

That's great, I'm the middel of trying to get t-mobile and ntl to remove mine too....well done though, your's were removed with little fuss too, eh?

Polarise - I have the same problem as well - I don't think I can send a CCA as utilities accounts are not credit agreements.

 

Could someone advise what letter is the best to send first to utilities companies where you cannot send a CCA or use that legislation.

I havent got any response to any letters i have sent and RM have said they canno trace them although sent recorded

I am sorry to bump an old thread but I am lost as to how BG can register a default on a credit account if it is not in itself a credit account?!

 

I have a default for a grand total of £23 registered on mine, this after it was promised it would be wiped as they broke the direct debit guarantee by taking this sum out on totally the incorrect date.

 

I did not pay the £23 as I was told it was written off, sadly though they thought it would be fun to default me instead.

And the latest score is...

the default is not applied as a default regulated under the cca regs.

Yeah I got a grand total of a £22 default registered. I was having difficulties getting credit and couldn't figure out why. I looke dup my credit report and BINGO - there it was. I don't know if I owe them the money and don't suppose they care very much either. However the sc**w people over dept there seems to think they can totally ram my life by doing this.

 

I will ask them nicely, but the bottom line is - is there any way of forcing them to remove this ? I have never signed anything or agreed that I owed them anything let alone £22.

 

I didn't think utilities had the right to do this. So can anyone who owes me money get discredited like this in public?
